THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 28 February 2007 be corrected to show his deployments to Operation Desert Storm and Operation Iraqi Freedom and to add the Iraq Campaign Medal. 2. The applicant states that he served in Operation Desert Storm from February through April 1991 and in Operations Enduring Freedom/Iraqi Freedom from February through June 2003. 3. The applicant provides his DD Form 214 for the period ending 28 February 2007; his Officer Record Brief; two DA Forms 1059 (Service School Academic Evaluation Report) for the period ending 3 June 1991; an Officer Evaluation Report (OER) for the period ending 25 March 1991; an OER for the period ending 1 December 2003; deployment orders, dated 12 February 2003; deployment orders, dated 13 February 2003, with an attached personnel roster; a copy of a change of address card; and a DD Form 2796 (Post-Deployment Health Assessment). CONSIDERATION OF EVIDENCE: 1. After having had prior service, the applicant entered active duty on 11 December 1982 as a chaplain. 2. The applicant deployed to Southwest Asia in support of Operation Desert Storm. A DA Form 1059 for the period ending 3 June 1991 shows he served in Operation Desert Storm from 25 January 1991 through 29 March 1991. 3. In February 2003, the applicant’s unit was alerted for deployment to Operation Enduring Freedom. He arrived in theater on 24 February 2003 (apparently in Kuwait as the war in Iraq did not start until 18 March 2003), served in Iraq, and departed Iraq on 2 June 2003. 4. The applicant was released from active duty on 28 February 2007 for the purpose of retirement. 5. For his service during Operation Desert Storm, the applicant’s DD Form 214 for the period ending 28 February 2007 shows he was awarded the Southwest Asia Service Medal with bronze service star and the Kuwait Liberation Medal (Saudi Arabia). This DD Form 214 shows no awards associated with his service in Iraq. 6. Item 18 (Remarks) of the applicant’s DD Form 214 for the period ending 28 February 2007 does not show any deployments. 7. Army Regulation 635-5 prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. In pertinent part, it states that for an active duty Soldier deployed to a foreign country, the statement, “SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates, for example, YYYYMMDD – YYYYMMDD)” will be entered in item 18. 8. Army Regulation 600-8-22 (Military Awards) states the Kuwait Liberation Medal awarded by the Government of Kuwait was approved on 9 November 1995 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993. 9. Army Regulation 600-8-22 states the Iraq Campaign Medal is authorized for service in direct support of Operation Iraqi Freedom on or after 19 March 2003 to a future date to be determined by the Secretary of Defense or the cessation of the operation. The area of eligibility encompasses all land area of the country of Iraq and the contiguous sea area out to 12 nautical miles and the air space above these areas. To qualify for award of this campaign medal, service members must have been assigned or attached to or mobilized with units operating in these areas of eligibility for 30 consecutive days or for 60 non-consecutive days or meet one of the following criteria: a) be engaged in combat during an armed engagement, regardless of the time in the area of eligibility; b) be medically evacuated from the area of eligibility for wounds or injuries resulting from participation in an operation or official duties; or c) participates as a regularly assigned air crewmember flying sorties into, out of, within or over the area of eligibility in direct support of the military operations [each day of operations counts as one day of eligibility]. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows that the applicant deployed to Southwest Asia from 25 January 1991 through 29 March 1991 during Operation Desert Storm. This deployment should be added to item 18 of his DD Form 214 for the period ending 28 February 2007. 2. The evidence of record shows that the applicant deployed to Kuwait/Iraq from 24 February 2003 through 2 June 2003. This deployment should be added to item 18 of his DD Form 214 for the period ending 28 February 2007. 3. The applicant meets the eligibility criteria for award of the Iraq Campaign Medal. He also meets the eligibility criteria for award of the Kuwait Liberation Medal (Kuwait). These awards should be added to his DD Form 214 for the period ending 28 February 2007. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. amending item 18 of his DD Form 214 for the period ending 28 February 2007 to add the entries: 1. “SERVICE IN SOUTHWEST ASIA FROM 19910125 - 19910329”; and 2. “SERVICE IN KUWAIT/IRAQ FROM 20030224 - 20030602”; and b. adding the Iraq Campaign Medal and the Kuwait Liberation Medal (Kuwait) to his DD Form 214 for the period ending 28 February 2007. _____Shirley L.
