RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 20 February 2008 DOCKET NUMBER: AR20070014771 I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. Ms. Catherine C. Mitrano Director Mr. Michael L. Engle Analyst The following members, a quorum, were present: Mr. Patrick H. McGann, Jr. Chairperson Ms. Eloise C. Prendergast Member Mr. Michael J. Flynn Member The Board considered the following evidence: Exhibit A - Application for correction of military records. Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier request for correction of his military records to show award of the Combat Infantryman Badge for service in the Republic of Korea. 2. The applicant states, in effect, that upon his arrival in the Republic of Korea, he was told that his military occupational specialty (MOS) of 0234 (Tailor) was not needed. Therefore, he was assigned to the 7th Military Police Company for duty as a stockade guard. Later, he was assigned for a time to the Special Platoon at Headquarters, 7th Infantry Division before being sent to a traffic platoon. After he received nonjudicial punishment, he was reassigned to the 32nd Infantry Regiment for duty with the Antitank and Mine Platoon. His job was to find and destroy enemy mines. 3. The applicant provides no supporting documentation. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20060009987, on 13 February 2007. 2. The available records show that the applicant served in the Republic of Korea from 16 March 1951 to 15 January 1952, but they do not provide information pertaining to his specific duty assignments. 3. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry military occupational specialty (MOS). They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size. DISCUSSION AND CONCLUSIONS: The applicant has clearly stated that he was trained as a tailor, but assigned for duty as a military policeman and later with an antitank and mine platoon. While he may have been assigned to the same or similar duties as an infantryman, there is no available evidence showing that he was ever awarded an infantry MOS. Therefore, his request for award of the Combat Infantryman Badge should be denied. Therefore, the Board determined that the overall merits of this case are insufficient as a basis to amend the decision of the ABCMR set forth in Docket Number AR20060009987, dated 13 February 2007. _____Patrick H.
