THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of the adjustment of his Major (MAJ) date of rank (DOR). 2. The applicant states, in effect, that he has the documentation to support adjusting his DOR from 12 June 2003 to 20 May 2003, the date the President approved the promotion board. 3. As new evidence, the applicant provides copies of DA Form 268 (Report to Suspend Favorable Personnel Actions) dated 12 September 2002, DA Form 705 (Army Physical Fitness Test Scorecard) dated 12 September 2002, and two DA Forms 5500 (Body Fat Content Worksheet) dated 12 June 2003 and one undated. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20070007159 on 13 September 2007. 2. The applicant was commissioned as a Captain (CPT) in the U. S. Army Reserve (USAR), Medical Corps, on 30 July 1996. Effective 15 January 2002, he was assigned to the 3274th U. S. Army Hospital, Fort Bragg, NC in a CPT position. 3. The applicant submitted new evidence to the Board for its review and consideration. The new evidence provided is a copy of the applicant's Army Physical Fitness Test (APFT) dated 12 September 2002, which shows he passed a record APFT and that his weight met the Standard Table Weight allowed. 4. Army Regulation (AR) 135-155 (Promotion of Commissioned Officers and Warrant Officers Other than General Officers) states in pertinent part, that an officer who has been recommended for promotion to the next higher grade must meet the requirements before being promoted in the Reserve component. An officer's promotion is automatically delayed when the officer is documented as overweight as defined in AR 600-9 or has failed the APFT most recently administered, or through his own fault has not taken and passed an APFT within the period required. DISCUSSION AND CONCLUSIONS: The applicant has provided sufficient evidence to support amending its previous decision by correcting his military record to show he was promoted to MAJ with a DOR of 20 May 2003, the date the President approved the 2003 Reserve Component Selection Board. The applicant has shown that he was in compliance with Army APFT and weight standards on 12 September 2002 which is his last record test prior to the publication of the Board results.
