Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests payment of board certification pay (BCP) for the period from 9 June 2004 to 30 November 2006. 2. The applicant states, in effect, that he did not file his board certification letter with the United States Army in June 2004 because he was under the assumption that the Army already knew he had passed his boards. He based this assumption on his subsequent fellowship training and assignment to Iraq. In 2007, when he returned from Iraq, he was informed of the error and filed his credentials and board certificate. However, due to policy limitations, he could only be paid for the previous year. 3. The applicant provides copies of his appointment orders, verification of certification to the American Board of Radiology, Certificate from The American Board of Radiology, and a printout showing his BCP commencing on 1 December 2006. CONSIDERATION OF EVIDENCE: 1. At the time of his application, the applicant was a major, Medical Corps, serving on active duty. 2. The American Board of Radiology Certificate shows that the applicant had satisfactorily completed his examinations on 9 June 2004, and was qualified to practice the specialty of diagnostic radiology. It further shows that this qualification is valid until 31 December 2014. 3. In the processing of this case, an advisory opinion was obtained from the Chief, Army Medical Department Special Pay Branch, Office of The Surgeon General (OTSG), Falls Church, Virginia. It stated, in effect, that the applicant was entitled to BCP commencing on 9 June 2004. BCP was paid effective 1 December 2006. However, the Defense Finance and Accounting Service had denied the OTSG authority to pay BCP in arrears for the period from 9 June 2004 to 30 November 2006. It recommended that the applicant be paid BCP in arrears. 4. On 26 December 2007, the applicant concurred with the advisory opinion. DISCUSSION AND CONCLUSIONS: The evidence clearly shows that the applicant qualified for BCP effective 9 June 2004. It further shows that he did not receive BCP until 1 December 2006. Therefore, his records should be corrected to show that he completed his certification and qualified for BCP commencing on 9 June 2004.
