Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his Certificate of Release or Discharge from Active Duty (DD Form 214) to show award of the Army Good Conduct Medal. 2. The applicant states, in effect, that he never received a negative counseling or any type of punishment. He performed all of his assigned duties to the best of his knowledge and strength which resulted in his acquiring great leadership skills and promotion to sergeant. 3. The applicant provides copies of his DD Form 214, certificate of achievement, two noncommissioned officer evaluation reports, and his petition for name change. CONSIDERATION OF EVIDENCE: 1. On 1 August 2002, the applicant enlisted in the Regular Army. He completed his initial training and was awarded military occupational specialty 74D (Chemical Operations Specialist). 2. On 1 November 2004, the applicant was promoted to the rank of sergeant, pay grade E-5. 3. The applicant was deployed to Kuwait from 14 February to 5 June 2003; and to Iraq from 7 March 2004 to 1 June 2005. 4. On 31 July 2005, the applicant was released from active duty and transferred to the United States Army Reserve Control Group (Reinforcement). He had completed 3 years of creditable active duty. His characterization of service was honorable. 5. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of the applicant’s DD Form 214 shows his awards as the Purple Heart, Army Commendation Medal, National Defense Service Medal, Iraq Campaign Medal, Global War on Terrorism Service Medal, Global War on Terrorism Expeditionary Medal, Army Service Ribbon, Army Lapel button, and the Driver and Mechanic Badge with Driver-W Bar. It does not show award of the Army Good Conduct Medal. 6. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service.  The current standard for award of the Army Good Conduct Medal is 3 years of qualifying service, but as little as one year is required for the first award in those cases when the period of service ends with the termination of active Federal military service. Denial requires the commander’s disqualifying comments. DISCUSSION AND CONCLUSIONS: 1. The evidence of record clearly shows that the applicant served a qualifying period of time for award of the Army Good Conduct Medal. He attained the rank of sergeant. He was awarded the Purple Heart and the Army Commendation Medal. Furthermore, there is no evidence showing that his commander took any action to deny him this award. 2. In view of the above, the applicant should be awarded the Army Good Conduct Medal.
