RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 22 April 2008 DOCKET NUMBER: AR20070018176 I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. Director Analyst The following members, a quorum, were present: M Chairperson M Member M Member Exhibit A - Application for correction of military records. Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier request for correction of Item 11d (Effective Date) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show he was released from active duty on 23 November 1967 instead of 2 November 1967. 2. The applicant states, in effect, that his expiration term of service date was 23 November 1967. 3. The applicant provides a copy of his DD Form 214, dated 23 November 1967, and a copy of his separation orders. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20070008581 on 30 October 2007. 2. The applicant was inducted into the Army of the United States on 18 January 1966 and served in military occupational specialty (MOS) 11B (Light Weapons Infantryman). He was honorably released from active duty and transferred to the U.S. Army Reserve Control Group (Annual Training) on 23 November 1967. 3. Item 11d of the DD Form 214 he was issued at the time of his separation shows the entry "23 November 1967." However, the "3" digit in his date of separation is almost illegible, even on the record carbon copies of the DD Form 214. 4. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of their military service. It is important that information entered on the form should be complete and accurate. This regulation specified that the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty to include attendance at basic and advanced training. The DD Form 214 will be prepared for all personnel at the time of their retirement, discharge, or release from active duty. The DD Form 214 was prepared in multiple copies, using carbon paper. In the version in effect at the time, the date the Soldier entered active duty status was entered in Item 10c and the last active duty date was entered in Item 11d. DISCUSSION AND CONCLUSIONS: 1. Although Item 11d on the applicant’s DD Form 214 properly shows he was released from active duty on 23 November 1967, this date is almost illegible on all copies of the form. 2. The purpose of the separation document is to provide the individual with documentary evidence of their military service. Therefore, in the interest of justice and equity, the applicant is entitled to correction of his records to show a clear, readable, and legible date of separation shown on his DD Form 214. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by issuing the applicant a DD Form 215 (Correction to the DD Form 214) that shows his date of release from active duty as 23 November 1967.
