RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 29 January 2008 DOCKET NUMBER: AR20080000808 I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. Ms. Catherine C. Mitrano Director Mr. Michael L. Engle Analyst The following members, a quorum, were present: Ms. Shirley L. Powell Chairperson Mr. Paul M. Smith Member Mr. Larry C. Bergquist Member Exhibit A - Application for correction of military records. Exhibit B - Military Personnel Records (including advisory opinion, if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier application for correction of his Armed Forces of the United States Report of Transfer or Discharge (DD Form 214) to show that his military occupational specialty (MOS) was 951.10 (Military Policeman). 2. The applicant states, in effect, that the entry shown on his DD Form 214 indicating his MOS as 551.10 (General Warehouseman) was the result of a typographical error. The clerk simply hit the "5" instead of the "9". 3. The applicant provides a copy of his Certificate of Training showing his completion of Advanced Individual Military Police Training, dated 9 June 1956. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20070008987 on 18 December 2007. 2. On 20 January 1956, the applicant was inducted into the Army of the United States. The training certificate provided by the applicant shows that he completed the Advanced Individual Military Police Training Course (MOS 950.00) on 9 June 1956. 3. On 2 November 1970, more than 2 years before the fire that destroyed many military records, a military clerk at the National Personnel Records Center, St. Louis, Missouri, provided a certified affidavit, attesting to the fact that the applicant's records then showed he had been awarded MOS 951.10 (Military Policeman) and that he had served in this specialty with the 8197th Army Unit from 5 July to 31 December 1956; and with the United States Army Garrison, Camp Fuji, in Japan from 1 January to 23 October 1957. Approximately 21 days later the applicant was released from active duty and transferred to the United States Army Reserve. 4. Records show that MOS 951.10 was subsequently re-designated as 95B1O. The duties of this MOS incorporate the duties of a security guard, desk officer, police officer, and detective. 5. The Dictionary of Occupational Titles (DOT) provides the following reference numbers: a. Police Officer: 375.263-014; and b. Security Guard: 375.667-034. DISCUSSION AND CONCLUSIONS: 1. The Board's earlier decision was based on the presumption of regularity and that it was the applicant's burden to show proof. 2. After a review of the previous evidence, along with the certificate of training (new evidence), it is evident that the applicant was initially trained as a military policeman and performed duties in this specialty during his entire period of active duty service. 3. It is highly unlikely that the applicant's specialty was changed to general warehouseman (551.10) during his last few weeks of his active duty service. In fact, the affidavit, written 13 years after his release from active duty, confirms his MOS was military policeman (951.10). 4. In view of the above, the applicant's request should be granted. BOARD VOTE: __LCB___ __PMS __ _SLP___ GRANT FULL RELIEF ________ ________ ________ GRANT PARTIAL RELIEF ________ ________ ________ GRANT FORMAL HEARING ________ ________ ________ DENY APPLICATION BOARD DETERMINATION/RECOMMENDATION: The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20070008987, dated 18 December 2007. As a result, the Board recommends that all Department of the Army records, in particular the DD Form 214, of the individual concerned be corrected by: a. showing in Item 25a (Specialty Number and Title): 951.10 Military Policeman; and b. showing in Item 25b (Related Civilian Occupation and D.O.T. Number): 375.263-014, Police Officer; and 375.667-334, Security Guard. _ _Shirley L.
