THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the following items on his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 20 February 2000 to show the correct service data: * Item 12a (Date Entered Active Duty This Period) to show he entered active service on 12 October 1988; * Item 12c (Net Active Service This Period) to show he served 11 years, 3 months, and 19 days active service; * Item 12d (Total Prior Active Service) to show he served 3 years, 1 month, and 5 days (3 years and 6 days enlisted time and 30 days Active Guard time) total prior active service; and * Item 12e (Total Prior Inactive Service) to show he served 6 years, 6 months, and 29 days total prior inactive service. 2. The applicant states that he entered active service on 21 May 1972 and his expiration term of service (ETS) was 27 May 1975 as an enlisted Soldier. He states the total time he served was 3 years and 6 months plus his service in the Individual Ready Reserve (IRR) from 28 May 1975 to 21 May 1978. Additionally, he served from 14 March 1985 to 9 October 1988 in the Pennsylvania Army National Guard (PAARNG). He further states he entered active service on 12 October 1988 and was discharged from active duty on 20 February 2000. 3. The applicant provides two DD Forms 214 for the periods ending 20 February 2000 and 27 May 1975; a letter from the Commonwealth of Pennsylvania, The Adjutant General of Pennsylvania, Department of Military and Veterans Affairs, Military Personnel Support Branch; his National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) for the period ending 16 May 1987; his NGB Form 22A (Correction to NGB Form 22), dated 23 January 1989; his NGB Form 22 for the period ending 9 October 1988; a memorandum from the Department of Military Affairs, Adjutant General’s Office, Commonwealth of Pennsylvania; his DD Form 4/1 (Enlistment/ Reenlistment Document), dated 14 March 1985; his DD Form 1966 (Application for Enlistment - Armed Forces of the United States); Headquarters, U.S. Army First Region, U.S. Army ROTC Cadet Command Orders 115-15, dated 23 June 1987; a Training and Doctrine Command (TRADOC) Form 855-R (Request for Waiver/Exception) with accompanying documents; his Army National Guard Retirement Credits Record; his DA Form 597 (Army Senior Reserve Officers’ Training Corps Student Contract); his DA Form 2-1 (Personnel Qualification Record - Part II); Commonwealth of Pennsylvania, Department of Military Affairs, The Adjutant General Orders 99-20, dated 26 May 1987; his DA Form 4836 (Oath of Extension of Enlistment or Reenlistment); Commonwealth of Pennsylvania, Department of Military Affairs, The Adjutant General Orders 99-22, dated 26 May 1987; U.AS. Army Reserve Personnel Center Orders A-08-005840, dated 31 August 1988; and Headquarters, U.S. Army Training Center and Fort Jackson Orders 361-1300, dated 27 December 1999. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 22 May 1972 and was released from active duty on 27 May 1975. On the following date, he was transferred to the U.S. Army Reserve (USAR) Control Group (Reinforcement) to complete his Reserve obligation. His DD Form 214 for the period ending 27 May 1975 shows he completed 3 years and 6 days total active service during this period. He was apparently discharged from the USAR on 21 May 1978. 2. After a break-in-service, the applicant enlisted in the PAARNG on 14 March 1985. He was discharged from the ARNG and as a Reserve of the Army on 16 May 1987, to accept an appointment in the USAR. His NGB Form 22 for the period ending 16 May 1987 shows he completed 2 years, 2 months, and 3 days of service during this period. He completed 2 years, 11 months, and 24 days prior Reserve component service and 3 years and 6 days prior active Federal service. 3. The applicant was appointed in the USAR on 17 May 1987. He was appointed in the Army National Guard on 19 May 1987 and was released from the Army National Guard on 9 October 1988. On the following date, he was transferred to the USAR Control Group (Officer Active Duty Obligor). 4. Department of the Army, U.S. Army Reserve Personnel Center, St. Louis, Missouri, Orders A-08-005840, dated 31 August 1988, ordered the applicant to active duty with a reporting date to his temporary duty station of 12 October 1988. 5. The applicant provided a memorandum, dated 1 February 1989, which indicates he was ordered to active duty and assigned to the U.S. Army Ordnance Center and School, Aberdeen Proving Ground, Maryland effective 12 October 1988. 6. The applicant was separated from active duty on 20 February 2000 and was transferred to the USAR Control Group (IRR) on the following date. His orders indicate he was discharged from active duty, not released from active duty. 7. Item 12a on his DD Form 214 for the period ending 20 February 2000 shows he entered active service this period on 6 October 1985. Item 12c on his DD Form 214 for the period ending 20 February 2000 shows he completed 14 years, 4 months, and 15 days net active service this period. 8. Item 12d and item 12e on his DD Form 214 for the period ending 20 February 2000 do not show he completed any prior active service or prior inactive service. 9 Army Regulation 635-5 (Separation Documents) governs the preparation of the DD Form 214. It states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge. DISCUSSION AND CONCLUSIONS: 1. The applicant served in the Regular Army from 22 May 1972 through 27 May 1975, which is a period of 3 years and 6 months active Federal service. He subsequently served in the USAR Control Group until 21 May 1978 for a period of 2 years, 11 months, and 24 days. 2. The evidence of record shows the applicant served two periods of service with the Army National Guard from 14 March 1985 to 16 May 1987 (in the USAR from 17 to 18 May 1978) and from 19 May 1987 to 9 October 1988, which is a total of 3 years, 6 months, and 26 days of service. 3. Orders published by the Department of the Army, U.S. Army Reserve Personnel Center, St. Louis, Missouri, dated 31 August 1988, ordered the applicant to active duty effective 12 October 1988. He continued to serve on active duty until he was discharged on 20 February 2000. However, his DD Form 214 erroneously reflects he entered active duty on 6 October 1985. Therefore, it would be appropriate to amend item 12a on his DD Form 214 for the period ending 20 February 2000 to show he entered active duty on 12 October 1988. 4. It appears that administrative errors have occurred in this case regarding the computation of the applicant’s total service. Therefore, it would be appropriate to correct his records to include his service in the Regular Army, the USAR Control Group, and the Army National Guard and to recalculate his total service.
