IN THE CASE OF: BOARD DATE: 23 September 2008 DOCKET NUMBER: AR20080006671 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that the entry in Item 12a, Date Entered Active Duty This Period, of his separation document, DD Form 214, be corrected from 29 August 2005 to 4 January 1998. 2. The applicant states that several other entries on his DD Form 214 clearly show that the Date Entered Active Duty This Period is incorrect. 3. The applicant provides selected excerpts from his military records. CONSIDERATION OF EVIDENCE: 1. The applicant’s military records show that he enlisted in the U.S. Army Reserve (USAR) Delayed Entry Program on 19 November 1997, and enlisted in the Regular Army on 5 January 1998. 2. The applicant was awarded the military occupational specialty of intelligence analyst, served continuously through reenlistments, and was promoted to pay grade E-6. 3. On 12 February 2006, the applicant was honorably discharged. Item 12a of his DD Form 214 has 29 August 2005 entered. Item 12c, Net Active Service This Period, has 8 years, 1 month, and 8 days entered. 4. Army Regulation 635-5 provides that, effective 1 October 1979, DD Forms 214 are not issued to enlisted service members who are discharged for immediate reenlistment. DISCUSSION AND CONCLUSIONS: 1. The applicant’s military records confirm that he enlisted on 5 January 1998, not 4 January 1998 as stated by the applicant. 2. However, since the applicant served continuously from the date of his enlistment, his DD Form 214, Item 12a, Date Entered Active Duty This Period, has an incorrect date entered. The correct date should be 5 January 1998. BOARD VOTE: ________ ________ ________ GRANT FULL RELIEF __X_____ ___X____ ____X__ GRANT PARTIAL RELIEF ________ ________ ________ GRANT FORMAL HEARING ________ ________ ________ DENY APPLICATION BOARD DETERMINATION/RECOMMENDATION: 1. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that the DD Form 214 of the individual concerned, Item 12a, Date Entered Active Duty This Period, be corrected to 5 January 1998. 2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to correcting Item 12a, Date Entered Active Duty This Period, to 4 January 1998. _________X_____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
