IN THE CASE OF: BOARD DATE: 7 August 2008 DOCKET NUMBER: AR20080006858 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his Armed Forces of the United States Report of Transfer or Discharge (DD Form 214) to show he attended “Raiders School.” 2. The applicant states that in 1964 or 1965, he attended Raiders School for 4 1/2 weeks as a member of the 82nd Airborne Division, and completed the training. 3. The applicant provides no supporting documentation. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 27 November 1962, the applicant enlisted in the Regular Army for 3 years. He completed his initial training and was awarded military occupational specialty (MOS 11H) Infantry Direct Fire Crewman). 3. On 17 April 1963, the applicant completed the Basic Airborne Course. On 19 April 1963, he was awarded secondary MOS 11C (Infantry Indirect Fire Crewman). He was subsequently assigned to the 505th Infantry Regiment, Fort Bragg, North Carolina. 4. During the period from 30 April to 23 October 1965, the applicant served in the Dominican Republic. He was awarded the Combat Infantryman Badge for this service. 5. On 26 November 1965, the applicant was released from active duty and transferred to the United States Army Reserve Control Group (Reinforcement). He had attained the rank of sergeant, pay grade E-5, and had completed 3 years of creditable active service. 6. Item 27 (Military Training) of the applicant’s Enlisted Qualification Record) is blank. Item 28 (Specialized Training) of this same form does not show “Raiders” training or school. 7. Review of the applicant’s military records did not show any documentation indicating attendance at, or completion of “Raiders School.” DISCUSSION AND CONCLUSIONS: The available evidence of record does not provide any substantiating documentation to support the applicant’s contention that he attended and completed “Raiders School.” Therefore, his request should be denied. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned. __________ _ X _______ ___ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
