THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, that the time she served in Kuwait in the war on terrorism be added to her DD Form 214, Certificate of Release or Discharge from Active Duty. 2. The applicant states, in effect, that she served in Kuwait; however, this fact was not added to her DD Form 214 due to the ACAP (Army Career and Alumni Program) personnel not fully explaining the requirement for ETS (expiration of term of service). 3. In support of her request, the applicant provides a copy of her DD Form 214, with an effective date of her release from active duty of 3 April 2008; a copy of a Defense Finance and Accounting Service (DFAS) - Indianapolis Center Travel Voucher (Voucher Number 293180), dated 6 March 2008; and a copy of Orders 176-002, Headquarters, Fort McPherson, Fort McPherson, Georgia, dated 25 June 2007. CONSIDERATION OF EVIDENCE: 1. The evidence shows that the applicant entered active duty on 26 July 1998. 2. On 25 June 2007, the applicant was assigned to the US Army Forces Central Command on a TCS (temporary change of station) status with a will proceed date of 20 July 2007 in support of Operation Iraqi Freedom (OIF) for a period of 365 days or until mission completion, by Orders 176-002. 3. DFAS - Indianapolis Center Travel Voucher Number 293180, dated 6 March 2008, shows that the applicant received a TDY (Temporary Duty) settlement for her travel from Fort McPherson, Georgia, to Kuwait City and Camp Doha, Kuwait, and return (for the period from 19 July 2007 through 8 January 2008, a period of 5 months and 20 days). 4. The applicant was discharged in the rank and pay grade of Captain, O-3, on 3 April 2008. On the date of her discharge, the applicant had completed 9 years, 8 months, and 8 day net active service. 5. Item 12f (Foreign Service), of the applicant's DD Form 214, shows the entry 0006 Years / 04 Months / 22 days. An entry is shown in Item 18 (Remarks) that reads as follows: "Served in designated imminent danger pay area // Service in Kosovo 20001008 – 20010414" //. The applicant's service in Kuwait is not accounted for nor shown on her DD Form 214. 6. Army Regulation (AR) 635-5 prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the active Army. It establishes standardized policy for preparing and distributing the DD Form 214. The edition of this regulation in effect on the date of the applicant's release from active duty specified that, total active duty outside continental limits of the United States for the period covered by the DD Form 214 would be entered in Item 12f. 7. AR 635-5, paragraph 2-4h(18)(f) prescribes that, for an active duty Soldier deployed with his or her unit during their continuous period of active service an entry will be made in Item 18 of the Soldier's DD Form 214 as follows to document his or her foreign service: SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD – YYYYMMDD). DISCUSSION AND CONCLUSIONS: 1. The applicant served in Kuwait in support of Operation Iraqi Freedom for the period 19 July 2007 through 8 January 2008. She is entitled to correction of Item 12f, of her DD Form 214, to show this additional foreign service; therefore, Item 12f should be corrected to show the applicant completed a total of 6 years, 10 months, and 12 days foreign service during the period covered by the DD Form 214. 2. The applicant is also entitled to correction of Item 18 (Remarks), of her DD Form 214, to show the entry, "Service in Kuwait from 20070719 – 20080108."
