Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) with the period ending 2 September 1985 to show he completed the Warrant Officer Entry Course (WOEC). 2. The applicant states that he completed the WOEC and needs the course added to his DD Form 214 so that it may appear in the Army American Council on Education Registry Transcript System (AARTS).) transcript 3. The applicant provides a WOEC completion certificate, dated 18 October 1984. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 16 November 1982 and successfully completed basic training and advanced individual training. He was awarded military occupational specialty 19D (Cavalry Scout). 3. The applicant was honorably discharged from active duty on 2 September 1985 to accept a commission as an Warrant Officer. Item 14 (Military Education) of his DD Form 214 with the period ending 2 September 1985 shows the entry "Warrant Officer Rotary Wing Aviator Course 42 weeks (Sep 95)//''NOTHING FOLLOWS"." 4. The applicant submitted a course completion certificate, dated 18 October 1984, that shows he completed the WOEC, Class 84-23. 5. On 1 June 2009, the Warrant Officer Career Center, at Fort Rucker, Alabama informed the Board analyst that at the time of the applicant's attendance at the Warrant Officer Candidate School at Fort Rucker, the WOEC was the first level of a five level process that lasted six weeks. 6. Army Regulation 635-5 (Separation Documents), in effect at that time, established the policies and procedures for completion and distribution of the DD Form 214. In pertinent part it states that item 14 (Military Education) will list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by title, length in weeks, and month and year completed. DISCUSSION AND CONCLUSIONS: Evidence of record shows that the applicant completed WOEC in 1984 at Fort Rucker, Alabama. Therefore, his DD Form 214 with the period ending 2 September 1985 should be corrected to add WOEC, 6 weeks, (1984) in item 14.
