THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests the removal of college transcripts that were posted to his Official Military Personnel File (OMPF) on 19 November 2007.

2.  The applicant states that the transcripts posted to his OMPF on 19 November 2007 are old transcripts that he submitted before he graduated from college and are no longer needed because the new transcript has been posted.  Accordingly, he desires to have the old transcript removed from his OMPF.

3.  The applicant provides no additional documents with his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 22 March 2000 for a period of 4 years, training as a diver and a cash enlistment bonus.  He completed his training and has remained on active duty through continuous reenlistments.  He was promoted to the pay grade of E-6 on 1 July 2004.

2.  On 19 November 2007, a college transcript was posted to the applicant's OMPF that indicates he had completed 48 credits. 

3.  On 9 December 2008, a college transcript was posted to the applicant's OMPF that indicates he was awarded an Associate of Science degree on 14 November 2008.

4.  Army Regulation 600-8-104 (Military Personnel Information Management/Records) prescribes the policies, operating tasks and steps governing the OMPF.  It provides, in pertinent part, that all transcripts of credit from civilian colleges, universities, trade schools or business schools will be filed in the OMPF for enlisted personnel. 

DISCUSSION AND CONCLUSIONS:

1.  In order to justify correction of a military record the applicant must, or it must otherwise satisfactorily appear, that the record is in error or unjust.  The applicant has failed to submit evidence that would satisfy that requirement.

2.  The transcript posted on 19 November 2007 is properly posted in the applicant's OMPF in accordance with the applicable regulation and the applicant has not provided sufficient justification for removing a document that appears to be properly filed in his records.

3.  The applicant's contention has been considered, however, the government has an interest in maintaining such records and the applicant has not shown sufficient basis as to why the transcript should not remain a matter of record.  Furthermore, in its current filing configuration, it reflects that the applicant has made steady progress in pursuing his civilian education.
