THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction to his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Army Good Conduct Medal and not the Air Force Good Conduct Medal. 2. The applicant states, in effect, that he served in the Army and his DD Form 214 shows he was awarded the Air Force Good Conduct Medal. 3. In support of his application, the applicant provides a copy of his DD Form 214. CONSIDERATION OF EVIDENCE: 1. The applicant's military records show that he enlisted in the Army Delayed Entry Program on 8 December 2005. He enlisted in the Regular Army in pay grade E-1 on 5 January 2006, for 3 years. 2. The applicant's military records located on the Integrated Personnel Electronic Records Management System show had never served in the military or Air Force prior to his entry on active duty. 3. The applicant was released from active duty in pay grade E-3 on 10 May 2009, at the completion of his required active service. Entries on his DD Form 214, Item 13 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized), lists the following awards: the Air Force Good Conduct Medal, the National Defense Service Medal, the Global War on Terrorism Service Medal, the Iraq Campaign Medal with Campaign Star, the Army Service Ribbon, the Overseas Service Ribbon, and the Combat Action Badge. 4. Army Regulation 600-8-22 (Military Awards) provides that the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant enlisted in the Regular Army without any prior military service. He was awarded the Good Conduct Medal during his period of service in the Regular Army. His DD Form 214 shows he was awarded the Air Force Good Conduct Medal based on an administrative error. 2. In view of the circumstances in this case, the applicant is entitled to have his DD Form 214 corrected to show he was awarded the Army Good Conduct Medal for his period of service from 5 January 2006 to 4 January 2009. 3. In view of the foregoing, the applicant’s records should be corrected as recommended below.
