IN THE CASE OF: BOARD DATE: 29 April 2010 DOCKET NUMBER: AR20090018295 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 6 July 2009 by changing the entry in block 2 (Department, Component, and Branch) from Army/Army National Guard of the United States (ARNGUS) to Army/U.S. Army Reserve (USAR). 2. The applicant states he was never a member of the Army National Guard, he was in the USAR. 3. The applicant provides copies of three DD Forms 214 as documentary evidence in support of this application. CONSIDERATION OF EVIDENCE: 1. The applicant's record shows he enlisted in the USAR for a period of 8 years on 28 June 2005. 2. The applicant's record contains (and he also provides) a DD Form 214 which shows he entered active duty on 2 August 2005 for the purpose of initial entry training. On 19 January 2006, he was released from active duty upon completion of training and transferred to the 324th Psychological Operations (PSYOP) Company, a USAR troop program unit (TPU) based in Aurora, Colorado. He was awarded military occupational specialty 37F (PSYOP Specialist). Block 2 of this DD Form 214 shows his component as "ARMY/USAR." 3. The applicant's record contains (and he also provides) a DD Form 214 which shows he was ordered to active duty on 3 January 2007 in support of Operation Iraqi Freedom. On 8 March 2008, he was released from active duty to the control of his USAR TPU, the 324th PSYOP Company. Block 2 of this DD Form 214 shows his component as "ARMY/USAR." 4. The applicant's record contains (and he also provides) a DD Form 214 which shows he was ordered to active duty on 28 September 2008. On 6 July 2009, he was released from active duty to the control of his USAR TPU, the 324th PSYOP Company. Block 2 of this DD Form 214 shows his component as "ARMY/ ARNGUS," indicating he was a member of the Army National Guard. 5. The Integrated Total Army Personnel Database maintained by the U.S. Army Human Resources Command shows the applicant's control group as USAR TPU. 6. The applicant's U.S. Army Reserve Personnel Command Form 249-E (Chronological Statement of Retirement Points), dated 8 April 2010, shows he has been a continuous member of the USAR since his enlistment on 28 June 2005. 7. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. In pertinent part, it states that block 2 of the DD Form 214 will show the Soldier's component at time of his/her separation, based upon his/her contract. DISCUSSION AND CONCLUSIONS: 1. The applicant's contention that block 2 of his DD Form 214 for the period ending 6 July 2009 should be corrected by changing the entry from "ARMY/ ARNGUS" to "ARMY/USAR" was carefully considered and determined to have merit. 2. The evidence clearly shows the applicant has been a continuous member of the USAR since his enlistment on 28 June 2005. 3. The evidence shows block 2 of the applicant's DD Form 214 for the period ending 6 July 2009 contains the erroneous entry, "ARMY/ARNGUS." Therefore, he is entitled to correction of this form to properly reflect his membership in the USAR.
