Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Meritorious Unit Commendation and a second award of the Army Commendation Medal. He also requests correction of Items 19a (Mailing Address After Separation) and 19b (Nearest Relative) to show the word "Ojos" instead of "Djos." 2. The applicant states the awards were approved after his separation and the address was misspelled. 3. The applicant provides a copy of his DD Form 214, dated 9 January 2010; a copy of the award recommendation approval, dated 29 October 2009; a copy of the 772nd Medical Detachment Modified Table of Organization and Equipment, dated 8 September 2009; and his DA Form 638 (Recommendation for Award), dated 12 November 2009, showing award of the Army Commendation Medal, in support of his request. CONSIDERATION OF EVIDENCE: 1. The applicant's records show he enlisted in the Regular Army on 30 September 2005 and held military occupational specialty 68W (Health Care Specialist). His records also show he served in Afghanistan from 7 July 2008 to 18 September 2009. He was assigned to the 722nd Medical Detachment. 2. He was honorably released from active duty on 9 January 2010 and he was transferred to the U.S. Army Reserve Control Group (Reinforcement) for completion of his Reserve obligation. 3. Item 13 of his DD Form 214 shows the Afghanistan Campaign Medal with a bronze service star, Army Commendation Medal, Army Achievement Medal, Good Conduct Medal, National Defense Service Medal, Global War on Terrorism Service Medal, Noncommissioned Officer Professional Development Ribbon, Army Service Ribbon, Overseas Service Ribbon, and NATO Medal. 4. Items 19a and 19b of his DD Form 214 show his mailing address after separation and his nearest relative's mailing address was the same address "6--- East C---- Djos V----" in Tucson, AZ. 5. Headquarters, 349th Combat Support Hospital (Forward), Afghanistan, Permanent Orders Number 09-194-22, dated 13 July 2009, awarded him the Army Commendation Medal for meritorious service from 10 July 2008 to 30 September 2009. 6. Headquarters, 86th Combat Support Hospital, Fort Campbell, KY, Permanent Orders Number 307-004, dated 18 November 2009, awarded him a second Army Commendation Medal for meritorious service from 30 September 2005 to 9 January 2010. 7. Permanent orders 322-08, issued by the U.S. Army Human Resources Command, Alexandria, VA, on 18 November 2009, awarded the 772nd Medical Detachment the Meritorious Unit Commendation for exceptionally meritorious service from 10 July to 23 September 2008. 8. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. The DD Form 214 is not intended to have any legal effect on termination of a Soldier’s service. Chapter 2 of this regulation states Item 19a and 19b will show a mailing address and address of nearest relative as provided by the Soldier and must be a permanent address. 9. Army Regulation 600-8-22 (Military Awards) states, in pertinent part, that the first Oak Leaf Cluster is awarded to denote the second and succeeding awards of certain decorations, among which is the Army Commendation Medal. DISCUSSION AND CONCLUSIONS: 1. Permanent orders show he was awarded a second Army Commendation Medal for meritorious achievement or service which is not shown on his DD Form 214; therefore, he is entitled to correction of his DD Form 214 to show the second award of the Army Commendation Medal. 2. Permanent orders awarded his unit in Afghanistan the Meritorious Unit Commendation while he was assigned to the unit. Therefore, he is entitled to correction of his DD Form 214 to show this unit award. 3. The applicant provided the entries in Items 19a and 19b of his DD Form 24. However, it appears the street address was misspelled the entries should be corrected to show "6---- East C---- Ojos V----" instead of "6--- East C---- Djos V---." There will be no harm to the Army or the Soldier if both addresses are corrected.
