THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, award of the United Nations Service Medal for Korea and the Humanitarian Service Medal for Vietnam. 2. The applicant states he served in Korea in 1963-1964 and 1965-1966 and he served in Vietnam in 1967-1968. He just found out about them. 3. The applicant provides no documentation to substantiate his request. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant entered active duty in the Regular Army on 17 April 1963, reenlisted on 27 November 1964 and served until 26 February 1968 when he was released from active duty and transferred to the U.S. Army Reserve. 3. He subsequently spent many years in the Army National Guard and active Reserve establishment and was recalled for active duty for Operation Desert Shield/Storm. 4. Army Regulation 600-8-22 (Military Awards) states the United Nations Service Medal is awarded to members of the Armed Forces of the United States dispatched to Korea or adjacent areas on behalf of the United Nations during the period between 27 June 1950 and 27 July 1954. Personnel awarded the Korean Service Medal automatically establish eligibility for the United Nations Service Medal. 5. Army Regulation 600-8-22 (Military Awards) states the Humanitarian Service Medal is awarded to members who, after 1 April 1975, distinguished themselves by meritorious direct participation in a Department of Defense approved significant military act or operation of a humanitarian nature. A service member must be on active duty at the time of direct participation, must have directly participated in the humanitarian act or operation within the designated geographical area of operation and within specified time limits, and must provide evidence that substantiates direct participation. DISCUSSION AND CONCLUSIONS: 1. The applicant states he served in Korea in 1963-1964 and 1965-1966 and he served in Vietnam in 1967-1968. 2. The applicant's service in Korea occurred after the authorized period for award of the United Nations Service Medal. 3. He served in Vietnam before the Humanitarian Service Medal was authorized. 4. In view of the foregoing there is no basis for granting the applicant's request.
