THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Army Good Conduct Medal, Republic of Vietnam Gallantry Cross with Palm Unit Citation, Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and any awards presented to his unit during his tour in Vietnam. 2. The applicant states the awards were omitted upon him leaving Vietnam and the Army. 3. The applicant provides his DD Form 214 and military records. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's record shows he was inducted into the Army of the United States on 7 August 1969. He completed basic combat and advanced individual training and was awarded military occupational specialty (MOS) 11D (Armor Reconnaissance Specialist). 3. Records show he served with Troop A, 2d Squadron, 1st Cavalry, 1st Field Force Vietnam, during the period 6 January to 24 September 1970 and with Headquarters and Headquarters Company, 1st Battalion, 77th Armor, 1st Brigade, 5th Infantry Division from 5 October to 23 November 1970. 4. On 6 August 1971, the applicant was honorably released from active duty (REFRAD). The DD Form 214 he was issued confirms he completed a total of 2 years creditable active service with no lost time. 5. Item 26 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 shows the National Defense Service Medal, Vietnam Service Medal with 2 bronze stars, Republic of Vietnam Campaign Medal with Device (1960), Combat Infantryman Badge, Purple Heart, and the Expert Marksmanship Qualification Badge with Rifle, Machinegun, and Grenade Launcher Bars. 6. Item 38 (Record of Assignments) of the applicant's DA Form 20 (Enlisted Qualification Record) shows he received "excellent" conduct and efficiency rating throughout his service. There is no record of any disciplinary actions taken against the applicant or a commander's disqualification for award of the Army Good Conduct Medal. 7. Army Regulation 672-5-1 (Awards), in effect at the time, stated the Army Good Conduct Medal was awarded for each 3 years of continuous enlisted active Federal military service completed on or after 27 August 1940; for first award only, 1 year served entirely during the period 7 December 1941 to 2 March 1946; and, for the first award only, upon termination of service on or after 27 June 1950 of less than 3 years but more than 1 year. The enlisted person must have had all "excellent" conduct and efficiency ratings. There must have been no convictions by a court-martial. 8. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) was published to assist commanders and personnel officers in determining or establishing the eligibility of Soldiers for campaign participation credit, assault landing credit, and unit citation badges awarded during the Vietnam Conflict. During his assignment to 2nd Squadron, 1st Cavalry, his unit was cited for Republic of Vietnam Gallantry Cross with Palm Unit Citation for the period 29 July 1969 - 17 November 1970 by Department of the Army General Orders 52, dated 1971 9. Army Regulation 600-8-22 (Military Awards), paragraph 2-13, contains the regulatory guidance on the Vietnam Service Medal. It states, in pertinent part, that a bronze service star is authorized with this award for each Vietnam campaign a member is credited with participating in. Appendix B shows that during his service in Vietnam, the applicant participated in the following three campaigns: * Vietnam Winter - Spring 1970 (1 November 1969 - 30 April 1970) * Sanctuary Counteroffensive (1 May - 30 June 1970) * Vietnam Counteroffensive Phase VII (1 July 1970 - 30 June 1971) DISCUSSION AND CONCLUSIONS: 1. The applicant's contentions that his record should be corrected to show award of the Army Good Conduct Medal, Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, as well as any other awards presented to his unit during his tour in Vietnam were carefully considered and determined to have partial merit. 2. Records show the applicant received "excellent" conduct and efficiency rating throughout his service. There is no evidence of any disciplinary actions or a commander's disqualification for award of the Army Good Conduct Medal. Therefore, he is entitled to award of the Army Good Conduct Medal (1st Award) for the period 7 August 1969 through 6 August 1971 and correction of his DD Form 214 to show this award. 3. DAGO 52, dated 1971, show the applicant's unit was awarded the Republic of Vietnam Gallantry Cross with Palm. Therefore, he is entitled to correction of his DD Form 214 to show this unit award. 4. There is no evidence that either of the applicant's units in Vietnam was cited for award of the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation. Therefore, he is not entitled to correction of is DD Form 214 to add this unit award. 5. Records show the applicant participated in three campaigns during his service in Vietnam. Therefore, he is entitled to correction of his DD Form 214 to three bronze service stars for wear on his already-awarded Vietnam Service Medal. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. deleting from item 24 of his DD Form 214 the Vietnam Service Medal; b. awarding him the Army Good Conduct Medal (1st Award) for the period 7 August 1969 through 6 August 1971; and c. adding to item 24 of his DD Form 214 the Army Good Conduct Medal (1st Award), Vietnam Service Medal with three bronze service stars, and the Republic of Vietnam Gallantry Cross with Palm Unit Citation. 2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.
