THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that the date he entered active duty be changed from 11 April 2009 to 8 March 2009 in item 12a (Date Entered Active Duty This Period) on his DD Form 214 (Certificate of Release or Discharge from Active Duty). 2. The applicant states the following: * He entered active duty on 8 March 2009, but his DD Form 214 shows he entered active duty on 11 April 2009 * The wrong date was entered in item 12a * Block 12c (Net Active Service This Period) on his DD Form 214 shows the correct amount of service 3. The applicant provides active duty orders, dated 1 December 2008; a DD Form 214 for the period ending 18 January 2010; and separation orders, dated 5 January 2010. CONSIDERATION OF EVIDENCE: 1. After completing prior enlisted service, the applicant was appointed as a Reserve commissioned officer on 3 June 1990. 2. Department of the Army, U.S. Army Human Resources Command, St. Louis (HRC-STL) MO, Orders M-12-805598, dated 1 December 2008, show the applicant was ordered to active duty in support of Operation Iraqi Freedom with a reporting date of 8 March 2009. 3. Department of the Army, Camp Shelby Joint Forces Training Center, Camp Shelby, MS, Orders 005-0008, dated 5 January 2010, released the applicant from active duty effective 18 January 2010. 4. Item 12 (Record of Service) of his DD Form 214 for the period ending 18 January 2010 shows he entered active duty on 11 April 2009 and was released from active duty on 18 January 2010, which equates to 9 months and 8 days of net active service this period. His DD Form 214 for the period ending 18 January 2010 shows he completed 10 months and 11 days net active service this period. 5. Army Regulation 635-5 (Separation Documents) governs the preparation of the DD Form 214. It states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge. In pertinent part, it directs that the beginning date of the continuous period of active duty will be entered in item 12a for issuance of this DD Form 214, for which a DD Form 214 was not previously issued. It further directs that for item 12c, enter the amount of service this period, computed by subtracting item 12a from item 12b (Separation Date This Period), less lost time, if any. DISCUSSION AND CONCLUSIONS: 1. Orders published by HRC-STL confirm the applicant was ordered to active duty on 8 March 2009. However, his DD Form 214 for the period ending 18 January 2010 reflects he entered active duty this period on 11 April 2009. 2. The applicant was released from active duty on 18 January 2010 and he completed 10 months and 11 days of active duty this period. 3. It appears the applicant’s date entered active duty this period was erroneously entered in item 12a on his DD Form 214 for the period ending 18 January 2010. 4. Therefore, it would be appropriate to amend item 12a of the applicant's DD Form 214 for the period ending 18 January 2010 to show he entered active duty this period on 8 March 2009.
