Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests one additional Army Commendation Medal (ARCOM) and Army Good Conduct Medal (AGCM) be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty). 2. The applicant states he received documentation for the requested awards subsequent to receiving his DD Form 214. 3. The applicant provides a copy of his Enlisted Record Brief (ERB). CONSIDERATION OF EVIDENCE: 1. The applicant's military record shows he enlisted in the Regular Army on 6 July 2006. 2. His Official Military Personnel File (OMPF) includes an ERB prepared on 16 September 2010. Section VII (Awards and Decorations) shows he earned the ARCOM and AGCM. 3. The applicant's OMPF does not include any orders announcing any military awards or decorations. 4. On 15 November 2010, the applicant was honorably released from active duty after completing 4 years, 4 months, and 10 days of creditable active military service. Item 13 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) includes the ARCOM and AGCM. 5. The applicant provides a copy of his ERB prepared on 8 November 2010. It shows he received two ARCOM awards. 6. Army Regulation 600-8-22 (Military Awards) states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. DISCUSSION AND CONCLUSIONS: 1. The applicant provides a copy of his ERB prepared one week prior to his REFRAD which shows he earned two ARCOM awards. As a result, it would be appropriate to correct item 13 of his DD Form 214 at this time to show both awards of the ARCOM. 2. By regulation, 3 years constitutes the qualifying period necessary for the AGCM. The evidence of record confirms the applicant completed 4 years, 4 months, and 10 days of honorable active duty service and received the AGCM for his initial 3 years of qualifying service from 6 July 2006 - 5 July 2009. Had he completed a subsequent 3 year period of qualifying honorable active duty service, he would have been entitled to a second AGCM. He completed an additional 1 year, 4 months and 10 days service and therefore did not satisfy the necessary criteria for a second AGCM. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. by amending item 13 of his DD Form 214 by deleting the entry "Army Commendation Medal" and replacing it with the entry "Army Commendation Medal (2nd Award); and b. issuing him a correction to his DD Form 214 to show this change. 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.
