IN THE CASE OF: BOARD DATE: 14 June 2011 DOCKET NUMBER: AR20100028508 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her reentry eligibility (RE) code from an RE-3 to an RE-1. 2. The applicant states she was honorably discharged and given an RE-3 code. She would like her RE code changed in order to join the U.S. Air Force. 3. The applicant provides a copy of her DD Form 214. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army (RA) on 6 September 2006. She held military occupational specialty 91G (Food Service Operation Specialist). 2. On 4 September 2008, the applicant voluntarily requested separation under the provisions of Army Regulation 635-200 (Personnel Separations - Active Duty Enlisted Administrative Separations), chapter 8, due to pregnancy. 3. On 27 October 2008, the separation authority approved her request and directed the issuance of an honorable discharge. On 15 November 2008, she was discharged accordingly. 4. Her DD Form 214 shows she was honorably discharged under the provision of Army Regulation 635-200, chapter 8, by reason of pregnancy or childbirth. This form confirms she completed 2 years, 2 months, and 10 days of creditable active service this period with 4 months and 27 days of prior active service. Her DD Form 1214 further shows in Item 26 (Separation Code) the entry "KDF" and in Item 27 (Reentry Code) the entry "3." 5. Army Regulation 635-5-1 (Separation Program Designator (SPD) Codes) provides the specific authorities (regulatory or directive), reasons for separating Soldiers from active duty, and the SPD codes to be entered on the DD Form 214. It states that the SPD code KDF is the appropriate code to assign to Soldiers separated under the provisions of Army Regulation 635-200, chapter 8, by reason of pregnancy or childbirth. The SPD/RE Code Cross Reference Table stipulates that an RE-3 code will be assigned to members separated under these provisions with an SPD code of KDF. 6. Army Regulation 635-200 further states that prior to discharge or release from active duty, individuals will be assigned RE codes based on their service records or the reason for discharge. Army Regulation 601-210 (Active and Reserve Components Enlistment Program), covers eligibility criteria, policies, and procedures for enlistment and processing into the RA and the U.S. Army Reserve (USAR). Table 3-1 included a list of the RA RE codes: a. RE-1 applies to Soldiers completing their term of active service who are considered qualified to reenter the U.S. Army. They are qualified for enlistment if all other criteria are met. b. RE-3 applies to Soldiers who are not considered fully qualified for reentry or continuous service at time of separation, but disqualification is waivable. They are ineligible for enlistment unless a waiver is granted. DISCUSSION AND CONCLUSIONS: 1. The applicant requests her RE code be corrected to show RE-1. 2. Her record shows she voluntarily requested separation under the provisions of Army Regulation 635-200, chapter 8, due to pregnancy. The RE code of 3 is the correct code to assign Soldiers who are assigned an SPD code of "KDF" due to pregnancy. Therefore, there is no basis for granting the applicant's requested relief.
