Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show his rank/grade as private first class (PFC)/E-3 and award of the Army Achievement Medal (AAM). 2. The applicant states his records were lost or not processed from overseas when he separated. 3. The applicant provides a DA Form 4187-E (Personnel Action), a DA Form 638 (Recommendation for Award), and an AAM Certificate. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Army on 20 January 1999. He served his initial enlistment and was honorably released from active duty on 23 January 2002. 2. The applicant's DD Form 214 shows his rank and pay grade as private (PV2)/E-2. It also shows he was awarded an AAM. 3. The applicant provided a DA Form 4187-E signed by his commanding officer, dated 29 August 2001, recommending him for advancement to private first class with a date of rank and effective date of 1 September 2001. Additional documents contained in his personnel service records show his rank as PFC/E-3. 4. During the processing of this case, a member of the Board's staff reviewed the applicant's financial record at the time of separation with the Defense Finance Accounting Service (DFAS). Financial records show that the applicant received E-3 pay at the time of separation. 5. Orders show the applicant was awarded the AAM on 16 September 2001. 6. Army Regulation 600-8-19 (Enlisted Promotions and Reductions) states that the DA Form 4187 is prepared prior to the Soldier’s eligibility date to ensure entitlements are received on time. Effective date and date of rank are the same unless stated otherwise in this regulation. A human resource specialist or the unit commander signs each DA Form 4187 executing promotions to PV2/E-2, PFC/E-3, and specialist/E-4. DISCUSSION AND CONCLUSIONS: 1. The applicant requests that his records be corrected to show his rank and pay grade as PFC/E-3 and his AAM. 2. Records show his commanding officer recommended the applicant for advancement on 29 August 2001; further, his financial and personnel records show his rank and pay grade as PFC/E-3. Therefore, it is appropriate to correct item 4a (grade, rate, or rank) and item 4b (pay grade) to reflect PFC/E-3 on his DD Form 214. 3. The applicant's records show that he was awarded an AAM, and this AAM is reflected on his DD Form 214; therefore, there is no corrective action needed with regard to the AAM.
