THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show that the last digit of his Social Security Number (SSN) is a “2” instead of a “7.” 2. The applicant states that his DD Form 214 incorrectly reflects the last digit of his SSN as a “7” when in fact it is a “2.” 3. The applicant provides a copy of his Social Security Card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in Milwaukee, Wisconsin on 11 September 1969 for a period of 3 years and training as a wheeled vehicle repairman. At the time of enlistment he indicated the last digit of his SSN was a “2.” All of the applicant’s enlistment documents indicate that his SSN ends with the digit “2.” 3. On 18 December 1969, he completed his training and was transferred to Germany where he served until he was honorably released from active duty (REFRAD) on 16 April 1972. He served 2 years, 7 months, and 4 days of active service and his DD Form 214 that was issued at the time of REFRAD shows the last digit of his SSN is a “7.” 4. A review of the applicant’s official records clearly shows that the last digit of his SSN is a “2.” DISCUSSION AND CONCLUSIONS: 1. The applicant’s contention that his DD Form 214 incorrectly reflects that the last digit of his SSN is a “7” has been noted and found to have merit. 2. The applicant’s SSN when he enlisted contained a “2” in the last digit and remained so throughout his service. 3. However, it appears that an administrative error occurred at the time of his REFRAD and his DD Form 214 was incorrectly prepared to reflect a “7” as the last digit of his SSN. 4.
