THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests that the records of her deceased husband, a former service member (FSM), be corrected to show all of his awards and decorations and that he served in Korea. 2. The applicant states that the FSM's separation documents do not show all of his authorized awards and decorations. a. She states the FSM: (1) served in Korea from 23 June 1953 to 26 October 1954 and was assigned to Company G, 17th Infantry Regiment; (a) should be authorized the National Defense Service Medal, Korean Service Medal with 1 or 2 bronze service stars, United National Service Medal, and Combat Infantryman Badge; and (b) this overseas service should be recorded on his 31 January 1973, DD Form 214; (2) served in Germany: (a) from 13 November 1958 to 11 October 1961 and was assigned to Company C, 1st Armored Rifle Battalion, 48th Infantry Regiment; (b) from 30 December 1963 to 2 April 1966 and was assigned to Headquarters Company, 1st Battalion, 87th Infantry Regiment; and (3) served in Vietnam: (a) from 5 March 1968 to 6 April 1968 and was assigned to Company C, 2nd Battalion, 35th Infantry, 4th Infantry Division; (b) from 5 August 1969 to 4 August 1970 and was assigned to Headquarters and Headquarters Company, 3rd Brigade, 9th Infantry Division, and Company A, 99th Combat Service Support Battalion, 3rd Brigade, 9th Infantry Division; and (c) should be authorized the National Defense Service Medal with 1 bronze service star (2nd Award), Vietnam Service Medal with 1 silver service star and 1 bronze service star, Republic of Vietnam Gallantry Cross with Palm Unit Citation, Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and Combat Infantryman Badge (2nd Award); (4) was assigned to the 249th Hospital, Japan, U.S. Army Pacific (USARPAC) on 16 [sic] March 1968; and (5) was assigned to the Medical Holding Company (MHC), U.S. Army Hospital, Signal and Training Center (USAHSCT), Fort Gordon, Georgia, from 6 April to 21 June 1968. (6) The FSM should also be authorized the Army Good Conduct Medal (6th Award), Expert Marksmanship Qualification Badge with Rifle (M-14 and M-16) Bar, Marksman Marksmanship Qualification Badge with Rifle (M-1) and Pistol (.45 caliber) Bars, and all unit awards that were awarded to his units during the periods he was assigned/attached to the units. b. She relates that the FSM said he was wounded in combat in Vietnam and requests award of the Purple Heart, if appropriate. 3. The applicant provides copies of the FSM's death certificate, his DA Form 20 (Enlisted Qualification Record), a certificate of military service, and three DD Forms 214 (Armed Forces of the United States Report of Transfer or Discharge). COUNSEL'S REQUEST, STATEMENT AND EVIDENCE: 1. Counsel requests, in effect, correction of the FSM's separation documents to show all of his awards and decorations. 2. Counsel states, in effect, he defers to the applicant. 3. Counsel provides no additional documentary evidence in support of the application. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The FSM enlisted in the Regular Army (RA) on 20 January 1953. He was awarded military occupational specialty (MOS) 111 (Light Weapons Infantryman). The FSM served continuously on active duty through 31 January 1973. 3. The FSM's DA Form 20 shows in: a. item 29 (Qualification in Arms) he qualified: * Marksman with the .45 caliber Pistol on 8 March 1958 * Expert with the M-14 Rifle on 27 April 1967 * Expert with the M-16 Rifle on 25 January 1968 and 2 November 1971 b. item 31 (Foreign Service) he served in: * Korea from 23 June 1953 through 26 October 1954 * Germany from 13 November 1958 through 11 October 1961 * Germany from 30 December 1963 through 2 April 1966 * Vietnam from 5 March through 6 April 1968 * Vietnam from 5 August 1969 through 4 August 1970 c. item 33 (Appointments and Reductions), in pertinent part, that he was advanced to private first class/pay grade E-3 (temporary) with a date of rank of 24 December 1953 per Company G, 17th Infantry Regiment, Unit Orders Number 46 (1953); d. item 38 (Record of Assignments) he was assigned to: * Company F, 17th Infantry Regiment [Korea], on 24 July 1953 * Company C, 1st Armored Rifle Battalion, 48th Infantry [Germany], on 23 November 1958 * Company B, 1st Battalion, 87th Infantry [Germany], from 1 January 1964 through 9 October 1965 * Headquarters Company, 1st Battalion, 87th Infantry [Germany], from 10 October 1965 through 1 April 1966 * Company C, 2nd Battalion, 35th Infantry, 3rd Brigade, 4th Infantry Division, USARPAC [Vietnam], and served in duty MOS 11B4O as a platoon sergeant from 19 March through 25 March 1968 * the Medical Holding Detachment (MHD), 249th General Hospital, USARPAC - Japan, as a patient from 26 March through 5 April 1968 * MHC, USAHSTC, Fort Gordon, Georgia, as a patient from 6 April through 20 June 1968 * Headquarters and Headquarters Company, 3rd Brigade, 9th Infantry Division, USARPAC [Vietnam], in duty MOS 71L4O as a transportation liaison [noncommissioned officer (NCO)], from 16 August through 22 November 1969 * Company A, 99th Combat Service Support Battalion, 3rd Brigade, 9th Infantry Division, USARPAC [Vietnam], in duty MOS 71L4O as a transportation liaison [NCO], from 23 November 1969 through 31 July 1970 e. item 40 (Wounds) is blank; and f. item 41 (Awards and Decorations) the Korean Service Medal, United Nations Service Medal, Combat Infantryman Badge, National Defense Service Medal (2nd Award), Vietnam Service Medal, Republic of Vietnam Campaign Medal with Device (1960), 3 Overseas Service Bars, Good Conduct Medal (1st Award - 19 January 1956), Good Conduct Medal (2nd Award - 19 January 1959), Good Conduct Medal (3rd Award - 19 January 1962), Good Conduct Medal (4th Award - 19 January 1965), Good Conduct Medal (5th Award - 19 January 1958), Good Conduct Medal (6th Award - 19 January 1971), Marksman Marksmanship Qualification Badge with Pistol (.45 caliber) Bar, and Expert Marksmanship Qualification Badge with Rifle (M-14 and M-16) Bar. 4. Headquarters, 17th Infantry, Special Orders Number 246, dated 12 September 1953, awarded the FSM the Combat Infantryman Badge, effective 26 July 1953. The orders show the FSM was assigned to Company F. 5. The FSM's military service records do not contain a DD Form 214 for the period of service from 20 January 1953 through 27 November 1955. A Certification of Military Service issued by the National Archives and Records Administration on 8 December 2009 shows the FSM served honorably in the RA from 20 January 1953 to 27 November 1955. 6. A DD Form 214 shows the FSM entered active duty on 28 November 1955 and he was honorably discharged on 28 August 1961 to reenlist in the RA. He completed 5 years, 9 months, and 1 day of net active service this period and he had completed 2 years, 10 months, and 8 days of other service. a. Item 26 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) shows the Good Conduct Medal and Marksman Marksmanship Qualification Badge with Rifle (M-1) and Pistol (.45 caliber) Bars. b. Item 27 (Wounds Received As A Result Of Action With Enemy Forces) shows the entry "None." 7. A DD Form 214 shows the FSM entered active duty on 29 August 1961 and he was honorably discharged on 28 August 1967 to reenlist in the RA. a. He completed 6 years of net active service this period. b. Item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) shows the Good Conduct Medal (2nd Award) and National Defense Service Medal (2nd Award). 8. Headquarters, John F. Kennedy Center for Special Warfare (Airborne), Fort Bragg, North Carolina, General Orders Number 45, dated 28 April 1969, awarded the FSM the Army Commendation Medal for meritorious service from 25 September 1967 to 30 April 1969. 9. Headquarters, II Field Force Vietnam, General Orders Number 3256, dated 12 August 1970, awarded the FSM the Bronze Star Medal for meritorious service from August 1969 to August 1970. 10. A Standard Form 93 (Report of Medical History) completed by the FSM on 16 August 1972 for the purpose of his retirement physical examination shows in item 20 (Have you ever had any illness or injury other than those already noted?) the FSM placed a checkmark in the "Yes" column. In the space to explain the response he wrote "I was medevac [medically evacuated] out of Vietnam in 1968 and spent 5 months in the hospital at Fort Gordon, GA because of back problem when [I] was hurt in Vietnam…" The FSM and examining physician each placed their signature on the document. 11. A DD Form 214 shows the FSM entered active duty this period on 29 August 1967, was honorably retired from active duty on 31 January 1973, and transferred to the U.S. Army Reserve Control Group (Retired). He completed 5 years, 5 months, and 2 days of net active service this period and 20 years and 11 days of total active service. a. Item 24 shows the Vietnam Service Medal with one silver service star and one bronze service star, Republic of Vietnam Campaign Medal with Device (1960), two Overseas Service Bars, and Good Conduct Medal (5th and 6th Awards). b. Item 30 (Remarks), in pertinent part, shows: "Vietnam Service: 5 March 1968-6 April 1968; 5 August 1969-4 August 1970; Indochina-Yes; Korea-No." 12. The applicant's military personnel record does not contain any orders or other evidence showing he was recommended for or awarded the Combat Infantryman Badge (2nd Award). 13. A review of the Vietnam casualty roster revealed the applicant's name is not on the roster. 14. A review of the Awards and Decorations Computer-Assisted Retrieval System, an index of general orders issued during the Vietnam-era between 1965 and 1973 maintained by the Military Awards Branch of the U.S. Army Human Resources Command, failed to reveal orders pertaining to award of the Purple Heart to the applicant. 15. Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations. a. Paragraph 5-9 provides the regulatory guidance on the Korean Service Medal. It states that a bronze service star is authorized with this award for each Korean campaign a member is credited with participating in. b. Table B-1 contains a list of Korean War campaigns and it shows that during the applicant's tour in Korea with the 17th Infantry Regiment, he participated in the Korea Summer 1953 (1 May - 27 July 1953) campaign. c. Paragraph 2-13 provides the regulatory guidance on the Vietnam Service Medal. It states that a bronze service star is authorized with this award for each Vietnam campaign a member is credited with participating in. It also shows that one silver service star is authorized in lieu of five bronze service stars. d. Table B-1 contains a list of Vietnam Conflict campaigns and shows that during the applicant's tour of duty in Vietnam: (1) from 5 March through 25 March 1968, participation credit was awarded for the Tet Counteroffensive (30 January - 1 April 1968) campaign, and (2) from 5 August 1969 through 4 August 1970, participation credit was awarded for the following campaigns: * Vietnam Summer - Fall 1969 (9 June - 31 October 1969) * Vietnam Winter - Spring 1970 (1 November 1969 - 30 April 1970) * Sanctuary Counteroffensive (1 May - 30 June 1970) * Vietnam Counteroffensive Phase VII (1 July 1970 - 30 June 1971) 16. Department of the Army Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register) lists the unit awards received by units serving in the Korean Conflict. This document fails to show that the 17th Infantry Regiment was awarded any unit awards during the period of the applicant's assignment to the regiment. 17. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) shows unit citation badges awarded during the Vietnam Conflict. This pamphlet shows that at the time of the applicant's assignment to: a. Company C, 2nd Battalion, 35th Infantry, 3rd Brigade, 4th Infantry Division, the battalion was awarded the: * Meritorious Unit Commendation by Department of the Army General Orders (DAGO) Number 17 (1969) * Republic of Vietnam Gallantry Cross with Palm Unit Citation by DAGO Number 3 (1970) as amended by DAGO Number 38 (1970) * Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation by DAGO Number 53 (1970) b. Headquarters and Headquarters Company, 3rd Brigade, 9th Infantry Division, DAGO Number 55 (1971) awarded the company the: * Republic of Vietnam Gallantry Cross with Palm Unit Citation * Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation c. Company A, 99th Combat Service Support Battalion, 3rd Brigade, 9th Infantry Division, DAGO Number 51 (1971) awarded the battalion the: * Meritorious Unit Commendation * Republic of Vietnam Gallantry Cross with Palm Unit Citation * Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation d. the 249th General Hospital in a patient status, DAGO 75 (1969) awarded the Meritorious Unit Commendation to the hospital's personnel staff for their meritorious achievement in treating a total of 26,736 patients. e. There are no unit awards listed for the three units that the FSM was assigned to during his two overseas tours of duty in Germany or the MHC, USAHSTC, Fort Gordon, Georgia. 18. Army Regulation 600-8-22 also shows the: a. National Defense Service Medal is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and 30 November 1995, and 11 September 2001 and a date to be determined; b. Korean Service Medal is awarded for qualifying service in the Korea theater of operations between 27 June 1950 and 27 July 1954; c. United Nations Service Medal is awarded to members of the Armed Forces of the United States dispatched to Korea or adjacent areas on behalf of the United Nations during the period between 27 June 1950 and 27 July 1954. Personnel awarded the Korean Service Medal automatically establish eligibility for the United Nations Service Medal; and d. Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense. e. The Republic of Korea War Service Medal is awarded to members of the U.S. Armed Forces who served in Korea and adjacent waters between 25 June 1950 and 27 July 1953. The service must have been performed, in part, while on permanent assignment or on temporary duty for 30 consecutive or 60 non-consecutive days within the territorial limits of Korea or the waters immediately adjacent thereto. f. The Purple Heart is awarded to any member who was wounded or killed in action. A wound is defined as an injury to any part of the body from an outside force, element, or agent sustained in action in the face of the armed enemy or as a result of a hostile act of such enemy. In order to support awarding a member the Purple Heart, it is necessary to establish the wound for which the award is being made required treatment by medical personnel and the medical treatment for the wound or injury received in action must have been made a matter of official record. g. The Combat Infantryman Badge has been authorized for qualified Soldiers in any of four conflicts: (1) World War II (7 December 1941 to 3 September 1945); (2) the Korean Conflict (27 June 1950 to 27 July 1953); (3) the Vietnam Conflict (which includes service in Vietnam (2 March 1961 to 28 March 1973 and qualifying service in Laos (19 April 1961 to 6 October 1962)), the Dominican Republic (28 April 1965 to 1 September 1966), Korea on the demilitarized zone (4 January 1969 to 31 March 1994), Grenada (23 October to 23 November 1983), Panama (20 December 1989 to 31 January 1990), and the Persian Gulf War (17 January to 11 April 1991); and (4) the War on Terrorism (which includes Afghanistan, Operation Enduring Freedom, from 5 December 2001 to a date to be determined; and Iraq, Operation Iraqi Freedom, from 19 March 2003 to a date to be determined). h. The Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry MOS. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size. Additionally, Appendix V of U.S. Army Vietnam (USARV) Regulation 672-1 states that during the Vietnam era the Combat Infantryman Badge was awarded only to enlisted Soldiers who held and served in MOS 11B, 11C, 11D, 11F, 11G, or 11H. 19. Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribes policies and procedures regarding separation documents. It provides item-by-item instructions for completing the DD Form 214. The regulation in effect: a. at the time of the FSM's discharge on 28 August 1961 states for item 26 enter decorations awarded or authorized during the period covered by the DD Form 214 being prepared; omitting authorities cited therein; b. at the time of the FSM's discharge on 28 August 1967 states for item 24 enter all decorations, service medals, campaign credits, and badges awarded or authorized, omitting authorities cited therein; c. at the time of the FSM's retirement on 31 January 1973 states for: (1) item 24 enter all decorations, service medals, campaign credits, and badges awarded or authorized, omitting authorities cited therein; and (2) item 30 that the Remarks section will be used to complete entries too long for their respective blocks. It also states, "[i]ndicate Indochina and Korea service on or after 5 August 1964 by entering inclusive dates of service for Vietnam and indicating 'yes' or 'no' for service in Indochina and Korea. Where the record reflects assignment to an organization in Burma, Laos, Thailand, Cambodia, or Vietnam show 'yes' for Indochina. Sample entries are as follows: To show service in Vietnam only, 'Vietnam - 25 Apr 70 thru 28 May 71, Indochina - yes, Korea - no'; to show service in Indochina (other than Vietnam) only, 'Indochina- yes, Vietnam - no, Korea - no'; to show service in Korea only, 'Indochina - no, Vietnam - no, Korea - yes'." DISCUSSION AND CONCLUSIONS: 1. The applicant contends that the FSM's separation documents should be corrected to show his awards and decorations and his 31 January 1973 DD Form 214 should be corrected to show he served in Korea. 2. The applicant's claim on behalf of the FSM to a second award of the Combat Infantryman Badge for his service in Vietnam was carefully considered. a. Records show the applicant was awarded MOS 11B and he served in duty MOS 11B4O as a platoon sergeant while assigned to Company C, 2nd Battalion, 35th Infantry, 3rd Brigade, 4th Infantry Division, in Vietnam from 19 - 25 March 1968. However, this evidence, alone, is insufficient as a basis for a second award of the Combat Infantryman Badge. b. The evidence of record fails to show the FSM satisfactorily performed infantry duties during such time as his unit was in contact with the enemy, and that he was personally present and under fire while performing infantry duties. c. The applicant served in duty MOS 71L4O as a transportation liaison NCO in Vietnam from 16 August 1969 through 31 July 1970. As such, this service is not qualifying for award of the Combat Infantryman Badge. d. There are no orders or any other Army records that show the FSM was awarded the Combat Infantryman Badge (2nd Award), or that he was recommended for the badge. e. Therefore, in view of all of the foregoing, there is insufficient evidence to support a second award of the Combat Infantryman Badge to the FSM. 3. The applicant's claim on behalf of the FSM to award of the Purple Heart was carefully considered. a. Records show that at the time of his separation medical examination, the FSM acknowledged he was hurt in 1968 and medically evacuated from Vietnam because of a back problem. b. In order to support awarding a member the Purple Heart, it is necessary to establish the wound or injury for which the award is being made was sustained in action in the face of the armed enemy or as a result of a hostile act of such enemy, it required treatment by medical personnel, and the medical treatment for the wound or injury must have been made a matter of official record. c. There is no medical record to satisfy the strict requirement for award of the Purple Heart, and, the FSM's name is not listed on the Vietnam casualty roster. d. In view of all of the foregoing, there is insufficient evidence to support an award the Purple Heart to the FSM. 4. The evidence of record shows that during the period of service: a. From 20 January 1953 through his discharge on 27 November 1955, the FSM was authorized award of the National Defense Service Medal, Korean Service Medal with one bronze service star (i.e., for participation in one campaign), United Nations Service Medal, Combat Infantryman Badge, and subsequently authorized the Korea Defense Service Medal and the Republic of Korea War Service Medal. In the absence of a DD Form 214 for this period of service, no action can be taken to correct such document. b. From 28 November 1955 through his discharge on 28 August 1961, the FSM was authorized award of the Good Conduct Medal (2nd Award), National Defense Service Medal (2nd Award), and Marksman Marksmanship Qualification Badge with Rifle (M-1) and Pistol (.45 caliber) Bars. At the time of the FSM's discharge on 28 August 1961, only decorations awarded or authorized during the period covered by the DD Form 214 being prepared were to be entered in item 26. Thus, his 28 August 1961, DD Form 214 should be corrected to show only the awards cited in this subparagraph. c. From 29 August 1961 through his discharge on 28 August 1967, the FSM was authorized award of the Good Conduct Medal (4th Award) and Expert Marksmanship Qualification Badge with Rifle (M-14) Bar. At the time of the FSM's discharge on 28 August 1967, all decorations, service medals, campaign credits, and badges awarded or authorized were to be entered in item 26 of the DD Form 214. Thus, his 28 August 1967, DD Form 214 should be corrected to show all of the awards in this paragraph. d. From 29 August 1967 through his retirement on 31 January 1973, the FSM was authorized award of the Bronze Star Medal, Army Commendation Medal, Good Conduct Medal (6th Award), Vietnam Service Medal with one silver service star (i.e., for participation in five campaigns), Republic of Vietnam Campaign Medal with Device (1960), Meritorious Unit Commendation (2nd Award), Republic of Vietnam Gallantry Cross with Palm Unit Citation (3rd Award), Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation (3rd Award), Expert Marksmanship Qualification Badge with Rifle (M-14 and M-16) Bar, and two Overseas Service Bars. At the time of the FSM's discharge on 31 January 1973, all decorations, service medals, campaign credits, and badges awarded or authorized were to be entered in item 26 of the DD Form 214. Thus, his 31 January 1973, DD Form 214 should be corrected to show all of the awards in this paragraph. 5. Records show the FSM served in Korea from 23 June 1953 through 26 October 1954. There is no evidence the FSM served in Korea on or after 5 August 1964. Therefore, there is no basis for correcting item 30 of his 31 January 1973, DD Form 214 to show he served in Korea. 6. In view of all of the foregoing, it would be appropriate to correct the FSM's three DD Forms 214 to show his awards and decorations, as recommended below. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. correcting his 28 August 1961 DD Form 214 by: (1) deleting from item 26 the "Good Conduct Medal" and (2) adding to item 26 the Good Conduct Medal (2nd Award) and National Defense Service Medal (2nd Award); b. correcting his 28 August 1967 DD Form 214 by: (1) deleting from item 24 the "GCMDL (2d Awd)" and "NDSM (2d Awd)" and (2) adding to item 24 the Good Conduct Medal (4th Award), National Defense Service Medal (2nd Award), Korean Service Medal with one bronze service star, United Nations Service Medal, Korea Defense Service Medal, the Republic of Korea War Service Medal, Combat Infantryman Badge, Expert Marksmanship Qualification Badge with Rifle (M-14) Bar, and Marksman Marksmanship Qualification Badge with Rifle (M-1) and Pistol (.45 caliber) Bars; c. correcting his 31 January 1973, DD Form 214 by: (1) deleting all of the award entries, and (2) adding to item 24 the Bronze Star Medal, Army Commendation Medal, Good Conduct Medal (6th Award), National Defense Service Medal (2nd Award), Korean Service Medal with one bronze service star, Vietnam Service Medal with one silver service star, Korea Defense Service Medal, United Nations Service Medal, Republic of Vietnam Campaign Medal with Device (1960), Meritorious Unit Commendation (2nd Award), Republic of Vietnam Gallantry Cross with Palm Unit Citation (3rd Award), Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation (3rd Award), the Republic of Korea War Service Medal, Combat Infantryman Badge, Expert Marksmanship Qualification Badge with Rifle (M-14 and M-16) Bar, Marksman Marksmanship Qualification Badge with Rifle (M-1) and Pistol (.45 caliber) Bars, and two Overseas Service Bars. 2. The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.
