Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his record to show the Meritorious Unit Commendation (MUC) and an Iraq Campaign Streamer awarded to the 744th Military Police (MP) Battalion for service in Iraq. 2. He states he believes he has earned both citations his unit received. 3. He provides a press release; two DD Forms 214 (Certificate of Release or Discharge from Active Duty); and Lineage and Honors Information for Headquarters and Headquarters Detachment (HHD), 744th Military Police (MP) Battalion. CONSIDERATION OF EVIDENCE: 1. Campaign streamers are not entered in Soldier's records and they are not issued to individual Soldiers. They are issued to Army units for display on the unit's guidon. The portion of the applicant's request pertaining to the Iraq Campaign Streamer will not be discussed further in these proceedings. 2. The applicant enlisted in the U.S. Army Reserve (USAR) on 11 June 2001. He was honorably discharged on 6 December 2006. 3. His record includes a DD Form 214 covering the period 21 January 2003 to 12 January 2004. Item 8a (Last Duty Assignment and Major Command) shows at the time of his release from active duty he was assigned to Company B, Installation Support Battalion, Forces Command. Item 9 (Command to which Transferred) shows he was transferred to Headquarters and Headquarters Detachment (HHD), 744th MP Battalion, Bethlehem, PA. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) does not show he was authorized the MUC. Item 18 (Remarks) shows he was ordered to active duty in support of Operation Enduring Freedom/Operation Iraqi Freedom and served in Kuwait and Iraq during the period 23 March to 21 December 2003. 4. A review of his record in the interactive Personnel Electronic Records Management System (iPERMS) failed to reveal any documentation showing he was assigned to HHD, 744th MP Battalion, during his service in Kuwait and Iraq. 5. Department of the Army General Orders Number 11, dated 2009, awarded the MUC to HHD, 744th MP Battalion, and two assigned or attached units, the 79th MP Company and 186th MP Company, for the period 21 March 2003 to 4 April 2004. 6. The applicant provides a DD Form 214 covering the period 11 April to 30 November 2002. Item 8a shows he was assigned to Detachment 6, 744th MP Battalion, when he was released from active duty. Item 9 shows he was transferred to the 744th MP Battalion, Bethlehem, PA. 7. Army Regulation 670-1 (Uniforms and Insignia - Wear and Appearance of Army Uniforms and Insignia) provides the criteria for permanent wear of unit awards. It states a Soldier may wear a unit award permanently if the individual was assigned to, and present for duty with the unit any time during the period cited; or if the individual was attached by competent orders to, and present for duty with the unit during the entire period, or for at least 30 consecutive days of the period cited. DISCUSSION AND CONCLUSIONS: 1. The available documentation does not show the applicant was assigned to HHD, 744th MP Battalion, or either of two subordinate assigned or attached units during the period for which the units were cited for award of the MUC. 2. Although it appears the 744th MP Battalion was his "home" unit in the USAR, to correct his record to show this award requires documentation showing he was actually assigned to and present for duty with the unit during the cited period. Acceptable documentation may be orders assigning him for duty with the unit in Kuwait and Iraq or a citation for an individual award he received while he was deployed with the unit. In the absence of documentation, there is insufficient basis for granting the relief he requests.
