Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 3 (Social Security Number) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). 2. The applicant states his social security number (SSN) is incorrectly listed on his DD Form 214. 3. The applicant provides a copy of his SSN card and DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's military records show he enlisted in the Regular Army on 27 June 1969. The DD Form 4 (Enlistment Contract - Armed Forces of the United States) prepared during his enlistment processing lists the last four digits of his SSN as "4513." 3. The applicant's DA Form 20 (Enlisted Qualification Record ) prepared on him upon his entry on active duty lists his SSN four times of which three of these entries are lined through. The final entry records the last four digits of his SSN as "." 4. The majority of documents on file in the applicant's Military Personnel Records Jacket (MPRJ) list the last four digits of his SSAN as "4513." 5. His record also contains various documents which show the last four digits of his SSN as “.” Some of these documents include reassignment orders, award orders, and a DA Form 428 (Request for Identification Card). 6. On 25 January 1972, the applicant was honorably released from active duty after completing 2 years, 6 months, and 29 days of creditable active military service. Item 3 of his DD Form 214 lists the last four digits of his SSN as "." He authenticated this document with his signature in Item 21 (Signature of Member Being Separated). 7. The applicant provides a copy of his SSAN card, which confirms that the last four digits of his SSAN are “." DISCUSSION AND CONCLUSIONS: The evidence of record confirms that multiple documents contained throughout the applicant’s MPRJ list two different SSAN’s transposing the eighth and ninth digits of his SSN. He now submits an SSN card that confirms that the last four digits of his SSN are “.” As a result, Item 3 of the applicant’s DD Form 214 should be corrected accordingly.
