THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of Headquarters, 4th Brigade Combat Team (Airborne), 25th Infantry Division, Permanent Order Number 288-068, dated 15 October 2009, from his official military personnel file (OMPF). 2. The applicant states: * the Army Commendation Medal awarded to him during Operation Enduring Freedom needs to be removed from his OMPF because he was never issued this award * he was only in the unit that issued him the award for little over a month and he was subsequently issued a higher award from that unit * he tried to get the award removed from his file but was unsuccessful * he never knew he was issued this award and only just found out about it when he reviewed his promotion board file * he doesn't know whether this award should be removed from his record or if he should just keep it * he is worried that this will affect his promotion board file for captain, but his S-1 said this was not an issue as long as he let the U.S. Army Human Resources Command know, which he did 3. The applicant provides no additional evidence. CONSIDERATION OF EVIDENCE: 1. He is currently serving in the Regular Army in the rank of first lieutenant. 2. Headquarters, 4th Brigade Combat Team (Airborne), 25th Infantry Division, Permanent Order Number 288-068, dated 15 October 2009, shows he was awarded the Army Commendation Medal for exceptionally meritorious service in support of Operation Enduring Freedom for the period 1 March 2009 to 1 March 2010. 3. There is no evidence that shows these orders were revoked. 4. A review of his performance section of his OMPF and military personnel records jacket on the interactive Personnel Electronic Records Management System revealed a copy of the Army Commendation Medal orders. 5. Army Regulation 600-8-104 (Military Personnel Information Management/ Records) provides policies, operating tasks, and steps governing the OMPF. Table 2-1 shows that award orders are filed in the performance section of the OMPF. DISCUSSION AND CONCLUSIONS: 1. Although he contends he was never issued the Army Commendation Medal, orders show he was awarded the Army Commendation Medal on 15 October 2009. These orders appear to be valid and there is no evidence these orders have been revoked. Therefore, there is insufficient evidence on which to remove these orders from his OMPF. 2. He indicates he doesn't know whether this award should be removed from his record. It is suggested he contact the issuing headquarters to determine if the orders should be revoked. If the orders are revoked, he may apply to this Board to have the Army Commendation Medal orders and the revocation orders removed from his OMPF. He should provide a copy of the revocation orders that are published with his application/request.
