THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Purple Heart, Bronze Star Medal (BSM), and any other awards or unit citations to which he is entitled. 2. He states he received awards upon discharge that are not shown on his DD Form 214. 3. He provides a letter from the Department of Veterans Affairs. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 29 May 1968. After completing initial entry training, he was awarded military occupational specialty 11B (Light Weapons Infantryman). 3. On 14 September 1968, Headquarters, Second Advanced Individual Training Brigade, U.S. Army Training Center, Infantry, Fort Ord, CA, issued Special Orders Number 190 awarding him the Expert Marksmanship Qualification Badge with Machine Gun Bar. 4. Item 38 (Record of Assignments) of his DA Form 20 (Enlisted Qualification Record) shows he was assigned for duty in Vietnam with Company C, 1st Battalion (Airmobile), 327th Infantry, from 5 November 1968 to 9 November 1969. 5. Headquarters, 101st Airborne Division (Airmobile), issued: * General Orders Number 11432, dated 29 August 1969, announcing award of the Purple Heart to him for wounds received in action on 12 August 1969 * General Orders Number 12217, dated 19 September 1969, announcing award of the Air Medal (AM) to him for meritorious achievement on 18 July 1969 6. On 28 May 1970, he was honorably released from active duty. Item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows the: * National Defense Service Medal * Vietnam Service Medal (VSM) * Vietnam Campaign Medal with Device (1960) * Combat Infantryman Badge * Army Commendation Medal * Marksman Marksmanship Qualification Badge with Rifle Bar (M-16) * Expert Marksmanship Qualification Badge with Rifle Bar (M-14) 7. The record is void of documentation showing he was awarded the BSM. 8. A review of the Awards and Decorations Computer Assisted Retrieval System, an index of general orders issued during the Vietnam era between 1965 and 1973 maintained by the Awards and Decorations Branch of the U.S. Army Human Resources Command, failed to reveal orders awarding the BSM to him. 9. Army Regulation 600-8-22 (Military Awards) states the BSM is awarded in time of war for heroism and for meritorious achievement or service not involving participation in aerial flight in connection with military operations against an armed enemy or while engaged in military operations involving conflict with an opposing armed force in which the United States is not a belligerent party. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. 10. Army Regulation 600-8-22 states a bronze service star is worn on the appropriate service ribbon for each credited campaign, to include the VSM. The Vietnam campaigns are listed in appendix B. His record shows his service in Vietnam coincided with four campaigns: * Vietnam Counteroffensive Phase VI (2 November 1968 - 22 February 1969) * Tet 69 Counteroffensive 1969 (23 February-8 June 1969) * Vietnam Summer-Fall 1969 (9 June-31 October 1969) * Vietnam Winter-Spring 1970 (1 November 1969-30 April 1970) 11. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam. This pamphlet shows the 1st Battalion, 327th Infantry, was cited for award of the: * Republic of Vietnam (RVN) Gallantry Cross with Palm Unit Citation for the period 19 July 1968 to 14 May 1969 by Department of the Army General Orders (DAGO) Number 43, dated 1970 * RVN Civil Actions Honor Medal First Class Unit Citation for the period 18 March 1968 to 2 May 1970 by DAGO 48, dated 1971 DISCUSSION AND CONCLUSIONS: 1. General orders announced award of the Purple Heart to him for wounds he received in action on 12 August 1969 and award of the Air Medal for his meritorious achievement on 18 July 1969. Therefore, he is entitled to correction of his DD Form 214 to show these awards. 2 He was awarded the VSM and he participated in four campaigns while serving in Vietnam. Therefore, he is entitled to correction of his DD Form 214 to show four bronze service stars for wear on the previously-awarded VSM. 3. He was awarded the Expert Marksmanship Qualification Badge with Machine Gun Bar by special orders. Therefore, he is entitled to correction of his DD Form 214 to show this badge. 4. He was assigned to a unit in Vietnam during a period for which it was cited for award of the RVN Gallantry Cross with Palm Unit Citation and RVN Civil Actions Honor Medal First Class Unit Citation. Therefore, he is entitled to correction of his DD Form 214 to show these unit awards. 5. The available records do not support the applicant's request to add the BSM to his DD Form 214. In the absence of orders showing he received this award, there is no basis for adding it to his DD Form 214. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. deleting the VSM from item 24 of his DD Form 214 and b. adding to item 24 of his DD Form 214 the: * Purple Heart * AM * VSM with four bronze service stars * Expert Marksmanship Qualification Badge with Machine Gun Bar * RVN Gallantry Cross with Palm Unit Citation * RVN Civil Actions Honor Medal First Class Unit Citation 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief.
