THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 12a (Date Entered Active Duty This Period) of her DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 16 March 2010 to show she entered active duty on 17 March 2008 instead of 4 September 2002. 2. She states her DD Form 214 for the period ending 16 March 2010 shows she entered active duty on the date of her first enlistment. She separated from active duty on 14 December 2006 and later reentered active duty on 17 March 2008. Her first DD Form 214 is correct; however, her second DD Form 214 has an incorrect date of 4 September 2002 in item 12a. 3. She provides: * two DD Forms 214 for the periods ending 14 December 2006 and 16 March 2010 * Orders A-03-804499, dated 14 March 2008 * Orders 015-0002, dated 15 January 2010 * Service Computation for Separation (Automated) * Standard Form 180 (Request Pertaining to Military Records) * marriage certificate CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 4 September 2002 and she was released from active duty on 14 December 2006 after completion of 4 years, 3 months, and 11 days of active military service. On the following day, she was transferred to the U.S. Army Reserve Control Group (Reinforcement). She was issued a DD Form 214 which covers this period of service. 2. U.S. Army Human Resources Command, St. Louis (HRC-STL), MO, Orders A-03-804499, dated 14 March 2008, show the applicant was ordered to active duty for operational support with a reporting date of 17 March 2008. 3. Headquarters, U.S. Army Garrison, Presidio of Monterey, CA, Orders 015-0002, dated 15 January 2010, released the applicant from active duty effective 16 March 2010. 4. Item 12 (Record of Service) of her DD Form 214 for the period ending 16 March 2010 shows she entered active duty on 4 September 2002 and was released from active duty on 16 March 2010 which equates to 7 years, 6 months, and 13 days of net active service during this period. Her DD Form 214 for the period ending 16 March 2010 shows she completed 2 years of net active service during this period. 5. She provides an automated Service Computation for Separation Form which shows she served on active duty from 4 September 2002 to 14 December 2006 (4 years, 3 months, and 11 days) and from 17 March 2008 to 16 March 2010 (2 years). 6. On 8 July 2010, she submitted a Standard Form 180 wherein she requested a DD Form 215 (Correction to DD Form 214) to show she entered active duty on 17 March 2008 in item 12a of her second DD Form 214. 7. She provides a marriage certificate which shows she was married and changed her last name on 31 May 2008. 8. Army Regulation 635-5 (Separation Documents) governs the preparation of the DD Form 214. It states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. In pertinent part, it directs that the beginning date of the continuous period of active duty will be entered in item 12a for issuance of a DD Form 214 for which a DD Form 214 was not previously issued. It further directs that for item 12c, to enter the amount of service during this period, computed by subtracting item 12a from item 12b (Separation Date This Period), less lost time, if any. DISCUSSION AND CONCLUSIONS: 1. Orders published by HRC-STL confirm the applicant was ordered to active duty on 17 March 2008. However, her DD Form 214 for the period ending 16 March 2010 reflects that she entered this period of active duty on 4 September 2002. 2. The applicant was released from active duty on 16 March 2010 and she completed 2 years of active duty this period. It appears the applicant's date of entry on active duty for this period is erroneously entered in item 12a of her DD Form 214 for the period ending 16 March 2010. 3. Therefore, it would be appropriate to amend item 12a of the applicant's DD Form 214 for the period ending 16 March 2010 to show she entered this period of active duty on 17 March 2008.
