THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests award of additional 3 years of constructive service credit (CSC) for obtaining a combined Master of Health and Master of Business Administration degree. 2. He states he received 4 years of CSC after completing medical education under the Health Professional Service Scholarship Program and obtaining a Doctorate in Medicine. He adds that his total CSC should be corrected to 7 years to reflect relevant graduate level education and training obtained through a combined masters degree in Health and Business Administration. 3. He provides the following: * Three academic diplomas from the University of Missouri * Curriculum Vitae (CV) * Officer Record Brief (ORB) * Chronological Statement of Retirement Points, dated 28 September 2011 * Letter, Subject: Training Agreement for Army Graduate Medical Education (GME), (Applicant), dated 15 September 2009 * GME Selection Contingency - July/August 2010, dated 16 November 2009 * Medical Operational Data System (MODS), dated 25 August 2009 * Order Number 244-006, dated 1 September 2009 * Orders A-04-910612, dated 10 April 2009 * DA Form 71 (Oath of Office), dated 8 June 2009 CONSIDERATION OF EVIDENCE: 1. On 13 May 2005, the applicant was awarded a Master of Business Administration and a Master of Health Administration degree from the University of Missouri. 2. On 27 October 2005, he was appointed as a second lieutenant in the U.S. Army Reserve (USAR). 3. His DA Form 1059 (Service School Academic Evaluation Report) shows he successfully completed the Officer Basic Course on 22 July 2006. 4. On 15 May 2009, he was awarded a Doctor of Medicine degree from the University of Missouri. 5. On 7 June 2009, he was appointed as a Reserve commissioned officer in the rank of captain (CPT) in the Medical Corps (MC). He was ordered to active duty on that same date. The order shows his date of rank and grade of CPT were based on him receiving 4 years of CSC. 6. On 11 January 2012, the Program Manager, Graduate Medical Education Division, Office of the Surgeon General (OTSG) recommended disapproval of the applicant's request for additional CSC. The program manager stated that the applicant was requesting CSC for a combined masters in Health and Business Administration. She said in accordance with Department of Defense Instruction (DODI) 6000.13, paragraph 6.1.1.3, constructive credit may be awarded only if such advanced education or advanced degree was required as a prerequisite for original appointment as a commissioned officer in a particular officer category. Additionally, she said that paragraph 6.1.2 provides CSC to a person who begins commissioned service after obtaining the additional education, training or experience required for appointment, designation, or assignment as an officer in a health profession. She offered that the applicant's degree in combined health and business administration was not a prerequisite for his Doctor of Medicine degree. The degree was not required for appointment to the MC. 7. A copy of the advisory opinion was provided to the applicant for comment or rebuttal, but he failed to respond. 8. DODI 6000.13 is the governing directive in granting entry grade/constructive credit. a. In accordance with section 6.1.1.3 of this directive, CSC may be awarded only if such advanced education or advanced degree is required as a prerequisite for original appointment as a commissioned officer in a particular officer category. b. Section 6.1.2 states CSC provides a person who begins commissioned service after obtaining the additional education, training, or experience required for appointment, designation, or assignment as an officer in a health profession, with a grade and date of rank comparable to that attained by officers who begin commissioned service after getting a baccalaureate degree and serve for the period of time it would take to obtain the additional education. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant was awarded a Master of Business Administration and a Master of Health Administration prior to receiving his Doctor of Medicine degree in 2009 followed by his appointment in the MC. 2. As specified in the DODI 6000.13, paragraph 6.1.1.3, CSC may be awarded only if such advanced education or advanced degree was required as a prerequisite for original appointment as a commissioned officer in a particular officer category. The OTSG determined the applicant's degree in combined Health and Business Administration was not a prerequisite for his Doctor of Medicine degree and was not required for appointment to the MC. 3. There is no evidence and he has failed to provide sufficient evidence to overturn the OTSG's determination. It appears he was given all constructive credit due to him. In view of the foregoing, there is an insufficient basis to grant the requested relief.
