THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests his date of rank (DOR) be corrected and all of his awards be shown on his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 8 July 2008. 2. The applicant states: * He wants his awards and ribbons consolidated on one DD Form 214 * His current DD Form 214 has no awards or ribbons * His DOR is incorrect 3. The applicant provides: * Promotion orders, dated 22 August 2007 * DD Forms 214 for the periods ending 10 August 2001, 31 May 2002, 12 April 2004, and 8 July 2008 CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the California Army National Guard on 26 January 2001. He was ordered to active duty for training on 6 March 2001 and released from active duty on 10 August 2001. 2. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 for the period ending 10 August 2001 shows the: * Army Service Ribbon 3. He was ordered to active duty on 1 October 2001 in response to the World Trade Center and Pentagon attacks. He was released from active duty on 31 May 2002. 4. Item 13 of his DD Form 214 for the period ending 31 May 2002 shows the: * Army Service Ribbon 5. He was ordered to active duty on 15 March 2003 in support of Operation Enduring Freedom. He was released from active duty on 12 April 2004. 6. Item 13 of his DD Form 214 for the period ending 12 April 2004 shows the: * Army Lapel Button * Army Achievement Medal * National Defense Service Medal * Global War on Terrorism Service Medal * Armed Forces Reserve Medal with "M" Device * Army Service Ribbon 7. He was ordered to active duty on 10 October 2006. 8. He provided orders, dated 2 August 2007, which show he was promoted to sergeant effective 9 August 2007 with a DOR of 9 August 2007. 9. He was released from active duty on 8 July 2008. 10. His DD Form 214 for the period ending 8 July 2008 shows in: * Item 4a (Grade, Rate or Rank) the entry "SGT" [sergeant] * Item 4b (Pay Grade) the entry "E05" * Item 12h (Effective Date of Pay Grade) the entry "2007 09 01" [1 September 2007] * Item 13 the entry "NONE//NOTHING FOLLOWS" 11. On 23 January 2009, he was discharged from the Army National Guard and transferred to the U.S. Army Reserve Control Group (Reinforcement). His National Guard Bureau Form 22 (Report of Separation and Record of Service) shows his DOR as 9 August 2007. 12. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. The regulation states awards and decorations for all periods of service will be listed in item 13. DISCUSSION AND CONCLUSIONS: 1. The applicant requests that all of his awards be consolidated on his DD Form 214 for the period ending 8 July 2008. The governing regulation states awards and decorations for all periods of service will be listed in item 13 of the DD Form 214. Therefore, the applicant's DD Form 214 for the period ending 8 July 2008 should be corrected to show all of his awards and decorations. 2. The promotion orders provided by the applicant which show he was promoted to sergeant effective 9 August 2007 with a DOR of 9 August 2007 are accepted as sufficient evidence on which to amend item 12h of his DD Form 214 for the period ending 8 July 2008.
