THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests award of additional constructive service credit (CSC) for a Master of Business Administration (MBA) degree obtained prior to his acceptance into the Health Professional Service Scholarship Program. 2. He states he was commissioned as a captain upon completing medical school. He adds that prior to starting medical school, he completed an MBA degree. He maintains that based on this degree, he should have received additional CSC. 3. He provides the following: * Officer Record Brief * DA Form 67-9 (Officer Evaluation Report) * Memorandum, Subject: Request for Medical Additional Special Pay CONSIDERATION OF EVIDENCE: 1. On 1 July 1992, he enlisted in the Army National Guard (ARNG). 2. On 3 March 2003, the applicant completed DA Form 61 (Application for Appointment). In item 21 (Civilian Education), he listed that he had an MBA from the University of Utah, Salt Lake City, UT. 3. On 14 April 2003, he was honorably discharged from the ARNG in the rank of sergeant (SGT)/E-5. 4. On 15 April 2003, he was appointed as a second lieutenant in the U.S. Army Reserve. 5. On 18 June 2007, he was promoted to captain in the Medical Corps (MC). 6. On 7 November 2011, the Program Manager, Graduate Medical Education Division, Office of the Surgeon General (OTSG) recommended disapproval of the applicant's request for additional CSC. The program manager stated in accordance with Department of Defense Instruction (DODI) 6000.13, paragraph 6.1.1.3, constructive credit may be awarded only if such advanced education or advanced degree was required as a prerequisite for original appointment as a commissioned officer in a particular officer category. She added that the applicant's degree in business administration was not a prerequisite for his Doctor of Osteopathic Medicine degree. She further stated the masters degree would not reduce the length of training necessary for him to meet the specialty board requirements. 7. A copy of the advisory opinion was provided to the applicant for comment or rebuttal, but he failed to respond. 8. DODI 6000.13 is the governing directive in granting entry grade/constructive credit. In accordance with section 6.1.1.3 of this directive, CSC may be awarded only if such advanced education or advanced degree is required as a prerequisite for original appointment as a commissioned officer in a particular officer category. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant was awarded an MBA prior to his appointment in the MC. 2. As specified in the DODI 6000.13, paragraph 6.1.1.3, CSC may be awarded only if such advanced education or advanced degree was required as a prerequisite for original appointment as a commissioned officer in a particular officer category. The OTSG determined the applicant's degree in business administration was not a prerequisite for his Doctor of Osteopathic Medicine degree and was not required for appointment to the MC. 3. There is no evidence and he has failed to provide sufficient evidence to overturn the OTSG's determination. In view of the foregoing, there is an insufficient basis to grant the requested relief.
