THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests removal of the DA Form 2808 (Report of Medical Examination), dated 22 December 2010, from his official military personnel file (OMPF). 2. The applicant states he prefers that personal medical information not be filed in his OMPF. There is no guarantee that all personnel with OMPF access have received appropriate training or know how to protect sensitive medical information. 3. The applicant provides a copy of his DA Form 2808. CONSIDERATION OF EVIDENCE: 1. Having had prior enlisted service, the applicant underwent a physical examination on 22 December 2010, for the purpose of appointment as a warrant officer. He was found medically qualified for warrant officer appointment. 2. His DD Form 2808, which was used to record the determination of medical fitness, is filed on his OMPF. 3. He was appointed as a Reserve warrant officer on 9 February 2011. 4. Army Regulation 600-8-104 (Military Personnel Information Management/ Records) provides policies, operating tasks, and steps governing the OMPF. This regulation states that only those documents listed in table 2-1 (Composition of the OMPF) and table 2-2 (Obsolete or No Longer Used Documents) are authorized for filing in the OMPF. Depending on the purpose, documents will be filed in the OMPF in one of three sections: performance, service, or restricted. Table 2-1 shows that the Report of Medical History is filed in the service section of the OMPF. DISCUSSION AND CONCLUSIONS: 1. The applicant underwent a medical examination on 22 December 2010 for the purpose of appointment as a warrant officer. A DD Form 2808 was initiated and used for a determination of his medical fitness for this appointment. This form is properly filed in his OMPF as required by the regulation. 2. There is no evidence this form is filed in error or that he suffers or will suffer an injustice as a result of such filing. Therefore, there is no basis for granting his request.
