THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests his dates of service on his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 13 May 1985 be corrected. 2. The applicant states his DD Form 214 for the period ending 13 May 1985 does not show his true dates of service from 28 May 1971 to 1 September 1995. 3. The applicant provides: * Discharge orders, dated 15 June 1995 * Army National Guard Retirement Points History Statement * National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service * Oath of enlistment * DD Form 214 for the period ending 13 May 1985 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army (RA) on 28 May 1971. On 24 January 1974, he was honorably discharged for immediate reenlistment. 3. His DD Form 214 (Report of Separation from Active Duty) for the period ending 24 January 1974 shows he enlisted on 28 May 1971 and he was discharged on 24 January 1974 after completing 2 years, 7 months, and 27 days of creditable service. 4. He reenlisted in the RA on 25 January 1974 and he was honorably discharged for immediate reenlistment on 9 November 1977. 5. Item 15 (Date Entered Active Duty This Period) of his DD Form 214 for the period ending 9 November 1977 shows the entry "74 01 25" (25 January 1974). Item 9d (Effective Date) shows the entry "77 11 09" (9 November 1977). Item 15b (Prior Active Service) shows the entry "02 07 27" (2 years, 7 months, and 27 days). 6. He reenlisted in the RA on 10 November 1977 and he was honorably discharged for expiration term of service on 13 May 1985. 7. Item 12a (Date Entered Active Duty This Period) of his DD Form 214 for the period ending 13 May 1985 shows the entry "77 11 10" (10 November 1977). Item 12b (Separation Date this Period) shows the entry "85 05 13" (13 May 1985). Item 12d (Total Prior Active Service) shows the entry "06 05 12" (6 years, 5 months, and 12 days). 8. He enlisted in the Army National Guard (ARNG) on 26 March 1986. On 25 March 1995, he was honorably discharged and transferred to the Retired Reserve. 9. His NGB Form 22 shows he enlisted in the ARNG on 26 March 1986 and he was honorably discharged on 25 March 1995. Item 10c (Prior Active Federal Service) of his NGB Form 22 shows he completed 13 years, 11 months, and 16 days (his prior active service). 10. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214 and states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. DISCUSSION AND CONCLUSIONS: 1. The DD Form 214 is a "snapshot in time" and is a reflection of the applicant's record of active Army service at the time of his separation from active duty. 2. The evidence of record shows the applicant enlisted in the RA on 28 May 1971 and he was discharged on 24 January 1974 which is reflected on his DD Form 214 for the period ending 24 January 1974. He reenlisted in the RA on 25 January 1974 and was discharged on 9 November 1977 which is reflected on his DD Form 214 for the period ending 9 November 1977. He reenlisted in the RA on 10 November 1977 and was honorably discharged on 13 May 1985 which is reflected on his DD Form 214 for the period ending 13 May 1985. Therefore, there is no basis for granting his request to amend his DD Form 214 for the period ending 13 May 1985 to show his active duty service from 28 May 1971 through 9 November 1977. 3. Since his inactive service in the ARNG from 26 March 1986 to 25 March 1995 was after his discharge from active duty, there is no basis for showing this service on his DD Form 214 for the period ending 13 May 1985. 4. A copy of the applicant's DD Forms 214 for the periods ending 24 January 1974 and 9 November 1977 will be provided to the applicant with this Record of Proceedings.
