THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to add military occupational specialty (MOS) 67R2OY1 (AH-64 Attack Helicopter Repairer-Transition) and the associated training course.

2.  The applicant states this was not important to him before, but it is now.  He is unemployed and this will help him get a job.

3.  The applicant provides a copy of his Army/American Council of Education Registry transcript which shows completion of the course.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  After approximately 2 years of Army National Guard and U.S. Army Reserve service, the applicant enlisted in the Regular Army in pay grade E-3 on 26 September 1997.

3.  After training, he served in as a Bradley fighting vehicle systems mechanic until August 2000 when he attended a 16-week course in AH-64A attack helicopter repair.  He completed the course on 12 December 2000 and was awarded MOS 67R1O.

4.  In December 2002, he was promoted to sergeant (E-5) and awarded MOS 67R2O Y1, both effective on 1 October 2002.

5.  On 30 October 2003, he was honorably discharged due to the completion of his required service.  Neither MOS 67R nor the training course is listed on his DD Form 214.

6.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army.  It establishes standardized policy for preparing and distributing the DD Form 214.  The DD Form 214 requires in:

	a.  item 11 (Primary specialty), the listing of the MOS number, title, and time held (in months and years) of all specialties held for 1 year or more; and

	b.  item 14 (Military Education), the listing of all courses by title, number of weeks in duration, and year completed.

DISCUSSION AND CONCLUSIONS:

1.  The applicant completed the 16-week attack helicopter repair course and was awarded MOS 67R on 12 December 2000.  He held this MOS until his discharge on 30 November 2003, a period of 2 years and 11 months and 19 days (rounded to 3 years).

2.  These details should be shown in addition to the current entries in item 11 and item 14 of his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to his 30 November 2003 DD Form 214:

	a.  in item 11, "67R2OY1 – AH-64 Attack Helicopter Repairer-Transition – 3 years"; and

	b.  in item 14 "AH 64A Attack Helicopter Repairer Course, 16 weeks, 2000."
