Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his social security number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 14 December 1969. 2. The applicant states that the sixth digit of his SSN on his DD Form 214 is incorrectly entered as "2" and it should be entered as "9." 3. The applicant provides: * his DD Form 214 * a MEDICARE Health Insurance Card * a DD Form 2 (United States Uniformed Services Privilege and Identification Card) issued on 29 February 2000 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant had prior service in the U.S. Air Force. On 5 August 1967, he was appointed as a Reserve Warrant Officer of the Army in the rank/grade of warrant officer one (WO1)/W-1 in military occupational specialty (MOS) 286A (Communication-Electronic Repair Technician). 3. The applicant’s entire Military Personnel Records Jacket (MPRJ) shows the sixth digit of his SSN as "9." 4. On 31 May 1973, the applicant retired. His DD Form 214 for the period ending 31 May 1973 is the only document that shows the sixth digit of his SSN as "2" in item 3 (Social Security Number). 5. The applicant submitted a DD Form 2 and MEDICARE Health Insurance Card that shows the sixth digit of his SSN as "9." 6. The applicant’s military personnel jacket contains: * a DA Form 41 (Record of Emergency Data), dated 14 February 1972 * a DA Form 66 (Officer Qualification Record), prepared on 14 February 1972 * a DA Form 428 (Application for Identification Card), dated 5 October 1972 * Letter Orders Number S5-315, dated 17 May 1973, issued by the U.S. Army Military Center 7. The above documents show that the applicant’s sixth digit of his SSN as "9." DISCUSSION AND CONCLUSIONS: The applicant's DD Form 214 for the period ending on 31 May 1973 shows the sixth digit of his SSN as "2." His DD Form 2, MEDICARE Health Insurance Card, DA Form 41, DA Form 66, DA Form 428, and Letter Orders Number S5-315 confirms his DD Form 214 is incorrect; therefore, it should be corrected to reflect the sixth digit of his SSN as "9" as it is shown on his DA Form 41.
