THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests his social security number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 16 September 1968 be corrected to show his SSN as shown on his SSN card. 2. The applicant states the SSN on his DD Form 214 is incorrect. 3. The applicant provides his: * SSN card * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. He was inducted into the Army of the United States on 27 September 1966. He completed basic combat and advanced individual training and was awarded military occupational specialty 17K (Ground Surveillance Radar Crewman). 3. His DD Form 47 (Record of Induction) does not contain any entries or information concerning his SSN. At the time of his induction, military members were identified by a military service number. 4. The following documents in his Military Personnel Records Jacket (MPRJ) identified him with the SSN as shown on his SSN card: * DA Form 41 (Record of Emergency Data) * DA Form 20 (Enlisted Qualification Record) * DA Form 2376 (Notification to State Adjutants General Release from Active Duty of Obligated Reservist) * his orders for release from active duty, dated 16 September 1968 5. His records do not contain a DA Form 2139 (Military Pay Voucher). 6. Army Regulation 635-5 (Separation Documents), in effect at the time, stated the SSN in item 3 (Social Security Number) of the DD Form 214 would be transcribed from the Soldier's DA Form 2139. DISCUSSION AND CONCLUSIONS: 1. During the period of his service, Soldiers were primarily identified by their military service number. However, numerous documents in his MPRJ identify him with the SSN as shown on his SSN card and orders for release from active duty. 2. Therefore, it would be appropriate to change item 3 (Social Security Number) of his DD Form 214 to show his SSN as shown on his orders for release from active duty.
