THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his Social Security Number (SSN) as xxx-xx-x3xx instead of xxx-xx-x2xx. 2. The applicant states his DD Form 214 does not have his correct SSN. 3. The applicant provides: * his DD Form 214 * his Social Security card CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 8 December 1966. His DD Form 398 (Statement of Personal History), prepared on 11 October 1966, shows the applicant’s SSN as xxx-xx-x3xx. 3. The applicant’s Military Personnel Records Jacket (MPRJ) contains the following documents that show his SSN as xxx-xx-x3xx: * DA Form 3027 (U.S. Army Request for National Agency Check, dated 10 December 1966 * Special Orders Number 148, issued by Headquarters, U.S. Army Garrison, Fort Lewis, WA, dated 18 September 1968 * DA Form 2166 (Enlisted Efficiency Report), dated 20 December 1968 * Special Orders Number 346, issued by Headquarters, U.S. Army Personnel Center, Fort Lewis, dated 12 December 1969 4. On 14 December 1969, the applicant was honorably released from active duty at the expiration of his term of service. He completed 2 years, 11 months, and 9 days of total active service. Item 3 (SSN) of the DD Form 214 he was issued at the time shows his SSN as xxx-xx-x2xx. 5. Letter Orders Number 11-1449745, issued by the Office of the Adjutant General, U.S. Army Reserve Components Personnel and Administration Center, St. Louis, MO, dated 22 November 1972, honorably discharged the applicant from the standby Reserve. These orders show his SSN as xxx-xx-x3xx. 6. The applicant provided his Social Security card that shows his SSN as xxx-xx-x3xx. DISCUSSION AND CONCLUSIONS: 1. The applicant's DD Form 214 shows his SSN as xxx-xx-x2xx. The applicant's Social Security card and documents contained in his MPRJ confirm his SSN as xxx-xx-x3xx. It appears an administrative error occurred during the preparation of his DD Form 214 when his SSN was transposed as xxx-xx-x2xx instead of xxx-xx-x3xx. 2. In view of the foregoing, the applicant's DD Form 214 should be corrected to show his correct SSN.
