Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of the Board's denial of his previous request for correction of his DD Form 214 (Report of Separation from the Armed Forces of the United States) to show award of the Presidential Unit Citation and three campaign stars (properly known as bronze service stars). 2. He states he believes he is entitled to these awards and it was an oversight (that they were not added to his DD Form 214). He states he served 15 months on Okinawa and the remaining time of his foreign service was in Korea. He is submitting photocopies related to an article in the San Francisco News newspaper, dated 30 June 1952, detailing the arrival of the General W. A. Mann ship from the Far East with about 800 Korean combat veterans aboard. This is the ship he came back to the U.S. on proving that he was in Korea until June 1952. 3. He provides two photocopies related to an article in the San Francisco News newspaper. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20100027434, on 24 May 2011. 2. The photocopies of a news article and related picture of a ship arriving in San Francisco provided by the applicant are new evidence, which requires that the Board reconsider his request. 3. His available records show he enlisted in the Regular Army on 20 September 1948. He was honorably released from active duty on 16 July 1952. He completed 3 years, 9 months, and 27 days of active service with 2 years, 1 month, and 12 days of foreign service. 4. While in the Republic of Korea he was assigned to Company A, 440th Signal Battalion. The exact dates of his service in Korea are unknown. However, his available records contain documents that confirm he was assigned to Company A, 440th Signal Battalion from 9 September 1951 through 6 January 1952. 5. His current DD Form 214 shows the Korean Service Medal with two bronze service stars. It does not show the Presidential Unit Citation. 6. He provided two photocopies related to an article in the San Francisco News newspaper, dated 30 June 1952, detailing the arrival of the General W. A. Mann ship from the Far East with about 800 Korean combat veterans aboard. 7. Department of the Army Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register) shows the 440th Signal Battalion was cited for award of the Presidential Unit Citation for the period 1 October - 31 December 1950 by Department of the Army General Orders Number 457, dated 1951. 8. Army Regulation 670-1 (Wear and Appearance of Army Uniforms and Insignia) states unit awards are authorized for permanent wear by an individual who was assigned and present for duty with the unit at any time during the period cited. 9. Army Regulation 600-8-22 (Military Awards) states a bronze service star is worn on the appropriate service ribbon, including the Korean Service Medal, for each credited campaign. A review of the applicant's records shows he participated in the following two campaigns: * United Nations Summer-Fall Offensive (9 July – 27 November 1951) * Second Korean Winter 1951-1952 (28 November 1951 – 30 April 1952) DISCUSSION AND CONCLUSIONS: 1. The available evidence of record confirms that during his assignment in Korea he participated in two campaigns. His current DD Form 214 shows the Korean Service Medal with two bronze service stars. As such, there is an insufficient basis for which to correct his records to show a third bronze service star with this award. 2. Department of the Army Pamphlet 672-1 shows the 440th Signal Battalion was cited for award of the Presidential Unit Citation for the period 1 October - 31 December 1950. Evidence shows he was assigned to the unit on 9 September 1951, which is after the period covered for the award. Therefore, he is not entitled to have this award added to his records.
