The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the: * Southwest Asia Service Medal (SWASM) with two bronze service stars * Meritorious Service Medal (MSM) (3rd Award) 2. The applicant states the SWASM with two bronze service stars was overlooked and not added to his DD Form 214. He adds that the MSM was turned in late. 3. The applicant provides: * Self-authored statement * DD Form 214 * Enlisted Record Brief (ERB) * Certificate of award of the MSM CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Arkansas Army National Guard (ARARNG) on 6 October 1989. He completed training and was awarded military occupational specialty (MOS) 19D (Cavalry Scout). 2. He entered active duty in support of Operation Desert Shield/Desert Storm on 21 November 1990. He was honorably released from active duty on 7 June 1991. His DD Form 214 shows in item 18 (Remarks) that he served in Southwest Asia from 20 January 1991 to 13 May 1991. 3. His DA Form 2-1 (Personnel Qualification Record) shows in: * Item 5 (Overseas Service): Saudi Arabia - 20 January 1991 to 13 May 1991 * Item 9 (Awards, Decorations and Campaigns): Southwest Asia Service Medal and credit for two campaigns (Liberation and Defense of Kuwait and the Southwest Asia Cease Fire) * Item 27 (Remarks): Duty in Imminent Danger Pay Area from 20 January 1991 to 13 May 1991 in Southwest Asia 4. His record contains a National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service). This form shows he was honorably discharged from the ARNG on 21 July 1991 for enlistment in the U.S. Army Reserve (USAR), and that he received the Southwest Asia Service Medal with one bronze service star. 5. After serving in the USAR, he enlisted in the Regular Army on 6 August 1992. He held MOS 19Z (Armor Senior Sergeant) and he served in a variety of stateside or overseas assignments. The highest grade/rank he attained while serving on active duty was first sergeant (1SG)/E-8. 6. His record contains an ERB that shows in: * Section I (Assignment Information - Overseas Service/Deployment Combat Duty): Southwest Asia (Saudi Arabia) from 20 January 1991 to 13 May 1991 * Section VI (Military Education - Basic Marksmanship Qualification): M-16 rifle/2 July 2007/score 36 * Section VIII (Awards and Decorations): SWASM with two bronze service stars and the MSM (2nd Award) 7. On 31 October 2011, he was retired from active duty by reason of sufficient service for retirement. His DD Form 214 for this period of service shows he completed 19 years, 2 months, and 25 days of net active service this period, of which 5 years, 6 months, 7 days was credited as foreign service. Item 18 of his DD Form 214 contains the entry, "Served in an Imminent Danger Pay Area//Service in Iraq from 4 October 2004 to 23 September 2005" 9. His record contains three MSM Award Certificates which list Permanent Orders (PO) Number: * 062-3, issued by Headquarters, I Corps and Fort Lewis, Fort Lewis, WA, dated 3 March 2006, awarded him the MSM for the period 1 April 2002 to 28 February 2006 * 013-0029, issued by Headquarters, U.S. Army Armor Center, Fort Knox, KY, dated 13 January 2009, awarded him the MSM for the period 11 March 2006 to 31 January 2009 * 227-001, issued by Headquarters, XVIII Airborne Corps, Fort Bragg, NC, dated 15 August 2011, awarded him the MSM for the period 4 April 2001 to 4 April 2011 10. His record contains four ARCOM Award Certificates which list PO Number: * 053-07, issued by Headquarters, 1st Brigade, 1st Artillery Division, dated 1 August 1995, awarded him the ARCOM for the period 13 December 1993 to 5 August 1995 * 102-19, issued by Headquarters, 1st Brigade, 4th Infantry Division, Fort Hood, TX, dated 9 February 1999, awarded him the ARCOM for the period 4 September 1995 to 9 February 1999 * 003-7, issued by Headquarters, Aviation Brigade, Wheeler Army Airfield, HI, dated 3 January 2002, award him the ARCOM for the period 5 March 1999 to 17 February 2002 * 087-05, issued by Special Troop Battalion, Fort Lewis, dated 19 February 2003, awarded him the ARCOM for the period 19 February 2003 to 19 February 2003 11. Army Regulation 600-8-22 (Military Awards) states: a. The NDSM is awarded for honorable service as a member of the Armed Forces of the United States for any period between 27 July 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, 2 August 1990 and 30 November 1995, and 11 September 2001 to a date to be determined. To signify receipt of a second or subsequent award of the NDSM, a service star will be worn on the service ribbon by U.S. Army personnel so qualified. A second or third award of the NDSM is authorized for Soldiers who served in one or more of the time periods listed above. b. The SWASM is awarded to members of the Armed Forces of the United States who participated in Operations Desert Shield/Desert Storm in the designated area on or after 2 August 1990 to 30 November 1995. A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved designated campaigns are: * Defense of Saudi Arabia (2 August 1990 to 16 January 1991) * Liberation and Defense of Kuwait (17 January to 11 April 1991) * Cease-Fire Campaign (12 April 1991 to 30 November 1995) c. U.S. Army Basic Marksmanship Qualification Badges: a basic marksmanship qualification badge is awarded to indicate the degree in which an individual, military or civilian, has qualified in a prescribed record course and an appropriate bar is furnished to denote each weapon with which he or she qualified. Each bar will be attached to the basic badge that indicates the qualification last attained with the respective weapon. Basic qualification badges are of three classes. Expert, Sharpshooter, and Marksman. Basic marksmanship qualification badges are awarded to U.S. military and civilian personnel, and to foreign military personnel who qualify as prescribed. Permanent orders are not required for award of the Marksmanship badges. Approval of marksmanship badges may be announced via memorandum, letter, roster, or other locally devised form. 12. Field Manual 3-22.9 (Rifle Marksmanship M-16-/M-4-Series Weapons, paragraph 6-77 (Qualification Ratings) states that during rifle qualification one point is awarded for each round within or touching some part of the silhouette facing. Qualification rating for Expert is between 36 - 40 hits, sharpshooter is between 30 - 35 hits, and marksman is between 23 to 29 hits. 13. Army Regulation 635-5 (Personnel Separations - Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. Chapter 2 establishes standardized policy for the preparation of the DD Form 214. It states for: * item 13, enter the awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22 * item 18, for an active duty Soldier deployed with his/her unit during their continuous period of active service, enter "Service in (Name of Country Deployed) FROM (inclusive dates, YYYYMMDD - YYYYMMDD)" DISCUSSION AND CONCLUSIONS: 1. The applicant served in Southwest Asia from 20 January 1991 to 13 May 1991 and participated in the Liberation and Defense of Kuwait campaign and the Cease-Fire campaign. As such, he is entitled to correction of his DD Form 214 for the period ending 31 October 2011 to show the Southwest Asia Service Medal with two bronze service stars. 2. His DD Form 214 reflects two awards of the Meritorious Service Medal and one award of the Army Commendation Medal; however, the evidence of record shows he was awarded the Meritorious Service Medal on three separate occasions and the Army Commendation Medal on four separate occasions. Therefore he is entitled to correction of his DD Form 214 for the period ending 31 October 2011 to show three awards of the Meritorious Service Medal and four awards of the Army Commendation Medal. 3. His DD Form 214 reflects the award of one National Defense Service Medal; however, he served honorably between 2 August 1990 and 30 November 1995 and 11 September 2001 until his date of retirement on 31 October 2011. He is entitled to a second award of the National Defense Service Medal because he served during two qualifying periods of service for the award. Therefore, his DD Form 214 for the period ending 31 October 2011 should be corrected to show award of the National Defense Service Medal with one bronze service star. 4. His DD Form 214 did not list a marksmanship qualification badge. The evidence of record shows he earned a score of 36 which indicated he qualified expert with the M-16 rifle on 2 July 2007. Further, the Field Manual covering M-16 rifle marksmanship states that scores between 36 and 40 indicate expert qualification. Therefore, he is entitled to correction of his DD Form 214 for the period ending 31 October 2011 to show the Expert Marksmanship Qualification Badge with Rifle Bar (M-16).
