THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show an additional award of the Army Commendation Medal and Military Outstanding Volunteer Service Medal. 2. He states: * he was presented these awards after he left the service * his DD Form 214 was issued before the awards were approved so he just needs someone to update this document 3. He provides his DD Form 214, two DA Forms 638 (Recommendation for Award), and an award certificate for the Army Commendation Medal. CONSIDERATION OF EVIDENCE: 1. The applicant was appointed as a Reserve commissioned officer on 10 January 2006 in the rank of second lieutenant. He was ordered to active duty on 13 January 2006. 2. He served in Iraq from 6 May 2006 to 5 December 2006 and from 21 September 2008 to 20 September 2009. 3. While he was serving in Iraq, the following orders were published: a. Permanent Orders Number 303-013, dated 30 October 2006, awarding him the Combat Medical Badge for service on 30 September 2006. b. Permanent Orders Number 313-4, dated 8 November 2006, awarding him the Army Commendation Medal for meritorious service from 3 May to 27 November 2006. c. Permanent Orders Number 047-005, dated 16 February 2010, awarding him the Army Commendation Medal for outstanding service from 15 December 2006 to 27 November 2009. 4. He was discharged on 31 March 2011. His DD Form 214 shows award of the: * Army Commendation Medal (3rd Award) * Army Achievement Medal * National Defense Service Medal * Global War on Terrorism Service Medal * Iraq Campaign Medal with one campaign star * Army Service Ribbon * Combat Medical Badge 5. He provided a DA Form 638 which indicates the recommendation for award of the Military Outstanding Volunteer Service Medal was approved on 20 April 2011 for his volunteer service from 1 April 2009 to 11 February 2011. 6. He provided an award certificate which indicates he was awarded the Army Commendation Medal (4th Award) for meritorious service from 1 March 2010 to 1 April 2011 by Headquarters, First Army, Fort Gillem, GA, Permanent Orders Number 109-15, dated 19 April 2011. 7. He provided a DA Form 638 which shows he was awarded the Army Commendation Medal with 3rd Oak Leaf Cluster (indicating a 4th Award) by Permanent Orders Number 109-15, dated 19 April 2011. 8. Army Regulation 600-8-22 (Military Awards) states the Military Outstanding Volunteer Service Medal may be awarded to members of the Armed Forces of the United States and their Reserve Components who, subsequent to 31 December 1992, perform outstanding volunteer community service of a sustained, direct, and consequential nature. To qualify for award of the Military Outstanding Volunteer Service Medal a service member's volunteer service must meet the following requirements: (1) be to the civilian community, to include the military family community; (2) be significant in nature and produce tangible results; (3) reflect favorably on the Military Service and the Department of Defense; and (4) be of a sustained and direct nature. DISCUSSION AND CONCLUSIONS: 1. The applicant's DD Form 214 currently reflects the Army Commendation Medal (3rd Award). 2. Permanent Orders Number 109-15, dated 19 April 2011, indicate he was awarded the Army Commendation Medal with 3rd Oak Leaf Cluster, indicating a 4th Award. Therefore, he is entitled to correction of his DD Form 214 to show an additional award of the Army Commendation Medal. 3. The evidence of record shows he was awarded the Military Outstanding Volunteer Service Medal. Therefore, his DD Form 214 should be amended to reflect this service medal.
