THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his date of rank for first lieutenant (1LT)/O-2 to 12 October 2008.

2.  The applicant states an Army National Guard (ARNG) policy provided for chaplain candidates to be promoted to 1LT without completion of the Chaplain Officer Basic Course.  He also states he had a passing Army Physical Fitness Test (APFT) in April 2008, but when he broke his ankle in January 2009, he was flagged for not having a current APFT.  He should have been promoted in October 2008 and he should not have been flagged.

3.  The applicant provides, in support of his case, copies of his Oklahoma ARNG oath of office; Oklahoma ARNG orders, dated 28 September 2008; National Guard Bureau (NGB) Federal recognition orders; and an APFT Scorecard, last dated 5 April 2008.

CONSIDERATION OF EVIDENCE:

1.  The applicant, with 3 years prior active duty and 1 year of creditable Ready Reserve service in the 1990's, applied for and received an age waiver for the ARNG Chaplain Candidate Program in August 2006.  Effective 12 October 2006, he was granted Federal recognition in pay grade O-1 as a member of the Oklahoma ARNG.

2.  He moved from state to state at various points.   He was appointed as a second lieutenant (2LT)/O-1 chaplain candidate by the Missouri ARNG in August 2008 and was granted Federal recognition as a staff specialist.  On 9 January 2009, the Missouri ARNG reviewed his record and determined he was still qualified for the Chaplain Candidate Program.

3.  He attended and met the requirements of the Chaplain Basic Officer Leadership Course from May through August 2009 as a 2LT.  His Service School Academic Evaluation Report is signed by a Reserve lieutenant colonel chaplain and a Regular Army colonel chaplain.

4.  On 17 September 2010, he was appointed as a 1LT chaplain in the U.S. Army Reserve with 1 year of time in grade.

5.  Army Regulation 135-100 (ARNG and Army Reserve Appointment of Commissioned and Warrant Officers of the Army) sets forth the applicable policies and procedures.  There are no provisions for appointment of chaplain candidates above the 2LT level.

DISCUSSION AND CONCLUSIONS:

1.  There is no available evidence that the applicant should have been promoted because of his status as a chaplain candidate and none that his APFT status had any impact on the date of his promotion.  Indeed, the governing regulation specifically excludes promoting chaplain candidates beyond 2LT.

2.  Given that the school was run by career chaplains, it is improbable that students would not have been kept abreast of their promotion status.
