IN THE CASE OF: BOARD DATE: 17 May 2012 DOCKET NUMBER: AR20110023232 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his rank/grade as sergeant (SGT)/E-5 vice specialist (SPC)/E-4. 2. The applicant states, in effect, he completed his separation paperwork and went on terminal leave before he received his promotion to SGT. 3. The applicant provides orders and two certificates. CONSIDERATION OF EVIDENCE: 1. The applicant's records show he enlisted in the Regular Army on 7 August 2006 and he held military occupational specialty (MOS) 11B (Infantryman). He was promoted to the rank of SPC on 1 July 2008. He was assigned to 1st Battalion, 68th Armor Regiment, 3rd Brigade Combat Team (BCT), Fort Carson, CO. 2. Orders Number 206-15, dated 25 July 2011, issued by Headquarters, 3rd BCT, Fort Carson, CO, promoted the applicant to SGT, in MOS 11B2O, with a date of rank, and effective date of 1 August 2011. 3. He was honorably released from active duty on 4 August 2011 and transferred to the U.S. Army Reserve. He completed 4 years, 11 months, and 28 days of creditable active service. 4. The DD Form 214 he was issued shows the following entries in: * Item 4a (Grade, Rate or Rank) "SPC" * Item 4b (Pay Grade) "E-4" * Item 11 (Primary Specialty) "11B1P" * Item 12i (Effective Date of Pay Grade) "2008  07  01" * Item 21b (Date) shows the applicant signed this form on "19 July 2011" * Item 22b (Date) show the authorized official signed this form on "19 July 2011" 5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. In items 4a and 4b enter the active duty rank or grade and pay grade held at the time of separation from active duty. In item 11 enter the titles of all MOS served for at least 1 year and in item 12i enter the effective date of promotion to the current pay grade. DISCUSSION AND CONCLUSIONS: The evidence of record shows that effective 1 August 2011 the applicant was promoted to SGT, in MOS 11B2O, which is not shown on his DD Form 214. Therefore, he is entitled to correction of his DD Form 214 to show this information.
