IN THE CASE OF: BOARD DATE: 29 May 2012 DOCKET NUMBER: AR20110023562 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his Enlisted Record Brief (ERB) and DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Combat Infantryman Badge (CIB). 2. The applicant states the CIB is missing from his ERB and DD Form 214. 3. The applicant provides a copy of his CIB orders. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 15 August 2006. He completed training, to include Ranger and Airborne training, and he was awarded military occupational specialty (MOS) 11B (Infantryman). 2. He completed the Ranger course and he was assigned to 1st Battalion, 75th Ranger Regiment, Hunter Army Airfield, GA. 3. On 11 December 2009, he was honorably released from active duty at the completion of required active service in the rank/grade of corporal (CPL)/E-4. He completed 3 years, 3 months, and 27 days of creditable active service. The CIB is not listed on his DD Form 214. 4. Permanent Orders 351-009, issued by Headquarters, Joint Task Force, dated 17 December 2007, awarded him the CIB for satisfactory performance of duty while under hostile fire for the period 27 April to 5 June 2007. 5. Section VIII (Awards and Decorations) of his automated ERB, dated 1 October 2009, does not show award of the CIB. 6. Army Regulation 600-8-104 (Military Personnel Information Management/ Records) prescribes the policies and operating tasks for the Military Personnel Information Management/Records Program of the Military Personnel System. The ERB is a continuous-feed type form that will permit limited automation. The ERB is created, maintained, and updated while the Soldier is on active duty. Upon separation or discharge, the ERB is no longer maintained or updated. DISCUSSION AND CONCLUSIONS: 1. Permanent orders awarded him the Combat Infantryman Badge for the period 27 April to 5 June 2007. Therefore, his DD Form 214 should be corrected to show this award. 2. With respect to his request to have his ERB corrected to show the CIB, this form is a record of a Soldier's personnel management qualifications in the form of data. The ERB is not maintained or updated subsequent to a Soldier's separation from active duty. Therefore, he is not entitled to this portion of the requested relief. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to the correcting his Enlisted Record Brief to show the Combat Infantryman Badge. ___________X____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
