THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his request for award of the Army Superior Unit Award (ASUA). 2. He states he believes that assignment to Task Force 6-52 was not considered in the original case. 3. He provides the following: * DA Form 638 (Recommendation for Award), dated 13 April 1996 with Army Achievement Medal (AAM) certificate, dated 6 May 1996 * Memorandum, Subject: Authorization for Wear of the Armed Forces Expeditionary Medal (AFEM) for Operation Provide Cover, dated 15 July 1996 * Article titled "6th Battalion, 52nd Air Defense Artillery (ADA) Regiment" CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20110000845, on 21 July 2011. 2. The documents the applicant provided were not previously considered by the Board. 3. A DA Form 638 dated 13 April 1996 with a certificate, dated 6 May 1996, shows he was awarded the AAM while assigned to the 147th Maintenance Company (Forward) for his achievements during preparation for deployment to Southwest Asia as a member of Task Force 6-52 ADA. The period of the award was from 8 January 1996 to 28 February 1996. 4. The memorandum he provided, dated 15 July 1996, shows he was awarded the AFEM for Operation Provide Cover. 5. He provided an article describing the history of the 6th Battalion, 52nd ADA Regiment from organization in 1917 through inactivation in 2009. During the period of the applicant's assignment to Task Force 6-52, the article states that the unit was reactivated on 16 February 1996 at Shipton Kaserne, Ansbach, Germany. On 2 March 1998, the 6th Battalion, 52nd ADA was task organized as Task Force 6-52 ADA. The Battalion was subsequently awarded the Superior Unit Award for distinguished performance during its 1996 Southwest Asia Rotation. 6. A review of the Human Resources Command (HRC), Awards and Decorations, Unit Award website, shows that the 6th Battalion, 52nd ADA was awarded the ASUA for the period 1 October 1995 to 30 September 1996 by Department of the Army General Orders Number 25, dated 8 June 2001. 7. Army Regulation 600-8-22 (Military Awards) states the ASUA was created in 1985 to recognize outstanding meritorious performance by a unit in completing a difficult and challenging mission under extraordinary circumstances during peacetime. The criteria for award also requires that the unit display such outstanding devotion and superior performance so as to set it apart from and above other units with similar missions, defines “peacetime” as any period where wartime awards were not authorized in the geographic area in which the mission was executed, precludes award for purely humanitarian operations, and precludes award if the act has already been recognized by another unit award. 8. Army Regulation 670-1 (Wear and Appearance of Army Uniforms and Insignia) states unit awards are authorized for permanent wear by an individual who was assigned and present for duty with the unit at any time during the period cited or who was attached to and present for duty with the unit for at least 30 consecutive days of the period cited. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant was awarded the AAM while assigned to the 147th Maintenance Company (Forward) as a member of Task Force 6-52 ADA from 8 January 1996 to 28 February 1996. 2. The article describing the history of the 6th Battalion, 52nd ADA indicated the unit was reactivated on 16 February 1996 and was task organized as Task Force 6-52 ADA on 2 March 1998. However, information obtained from the HRC Awards website shows the ASUA was awarded to the 6th Battalion, 52nd ADA for the period 1 October 1995 to 30 September 1996. It appears the unit may have been using the designation “Task Force” before it was officially organized as a task force. 3. His award of the AAM verifies he was assigned to the 6th Battalion, 52nd ADA, for more than 30 days during the period the unit was cited for the ASUA. Therefore, it would be appropriate to add the ASUA to his DD Form 214.
