THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the DD Form 214 (Certificate of Release or Discharge from Active Duty) of her deceased husband, a former service member (FSM), to show "5" as the fifth digit of his social security number (SSN) instead of "1." 2. She states the incorrect SSN is on record. 3. The applicant provides copies of: * two DD Forms 214 * death certificate CONSIDERATION OF EVIDENCE: 1. A DD Form 214 for the period ending 29 June 1983 shows the FSM was discharged from the U.S. Marine Corps Reserve. His SSN on this form is shown with "5" as the fifth digit. 2. His record contains a DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States) which shows he enlisted in the Regular Army on 17 October 1984. His SSN is shown with "1" as the fifth digit. 3. A DD Form 1584 (National Agency Check Request) shows in item 4 (SSN) his SSN was originally completed using "5" as the fifth digit; however, this number was crossed out and replaced with a "1." The FSM initialed this correction. 4. On 16 October 1987, he was honorably released from active duty (REFRAD) and transferred to the U.S. Army Reserve (USAR) Control Group (Reinforcement) to complete his Reserve service obligation. Item 3 (SSN) of his DD Form 214 shows his SSN with "1" as the fifth digit. 5. His record contains the following documents which were filed in his Military Personnel Records Jacket (MPRJ) after his 1987 REFRAD. a. An Optional Form 41 (Routing and Transmittal Slip), dated 10 March 1989, shows his SSN was verified with the Social Security Administration (SSA) as having "5" as the fifth digit. b. A letter, dated 14 March 1989, subject: Discrepancy in SSN, was addressed to the FSM and shows his correct SSN with "5" as the fifth digit. c. Orders D-09-248399 issued by the USAR Personnel Center on 22 September 1992 depict "5" as the fifth digit of his SSN. 6. The applicant provides a copy of the FSM's death certificate which shows he passed away on 10 November 2011 and his SSN is shown with the fifth digit of "5." 7. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The regulation states the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. It is important that the information entered on the form be complete and accurate, reflecting the conditions as they existed at the time of separation. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the FSM incorrectly listed his SSN at the time of his enlistment in the Regular Army and this is the SSN which was used for the remainder of his active duty service. However, documentation verifying his correct SSN and official orders which were filed in his MPRJ show the FSM's correct SSN. 2. In view of the foregoing, it would be appropriate to grant relief by correcting the FSM's Army DD Form 214 to show his SSN as shown on his death certificate.
