Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, upgrade of his under other than honorable conditions discharge. 2. The applicant states there are no errors; he just wanted to be upgraded or find out about any Department of Veterans Affairs (VA) benefits he may be entitled to. 3. The applicant provides no supporting documentation. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 1 October 1980. He completed training and he was awarded military occupational specialty 11C (Indirect Fire Infantryman). The highest rank/grade he attained while serving on active duty was private first class (PFC)/E3. 3. The available records indicate charges were preferred against the applicant for violating Article 92 of the Uniform Code of Military Justice (UCMJ) by possessing and selling amphetamines. 4. Evidence shows the applicant consulted with counsel and he was advised of the basis for the contemplated trial by court-martial, the maximum permissible punishment authorized under the UCMJ, the possible effects of an under other than honorable conditions discharge, and of the procedures and rights available to him. Subsequent to receiving legal counsel, the applicant voluntarily requested discharge under the provisions of Army Regulation 635-200 (Personnel Separations – Enlisted Personnel), chapter 10, for the good of the service – in lieu of trial by court-martial. 5. In his request for discharge, the applicant indicated he understood that by requesting discharge he could be deprived of many or all Army benefits, he could be ineligible for many or all benefits administered by the VA, and he could be deprived of his rights and benefits as a veteran under both Federal and State laws. He elected not to submit a statement in his own behalf. 6. On 11 August 1982, the applicant's immediate and intermediate commanders recommended approval of his voluntary request for discharge under the provisions of Army Regulation 635-200, chapter 10. 7. On 13 August 1982, the separation authority, a brigadier general, approved the applicant's request for discharge under the provisions of Army Regulation 635200, chapter 10 and directed he receive an Under Other Than Honorable Conditions Discharge Certificate. On 27 August 1982, the applicant was discharged accordingly. He completed 1 year, 10 months, and 27 days of creditable active service. 8. There is no indication the applicant applied to the Army Discharge Review Board for an upgrade of his discharge within its 15-year statute of limitations. 9. Army Regulation 635-200 governs the policies and procedures for the separation of enlisted personnel. a. Chapter 10 provides that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge for the good of the service in lieu of trial by court-martial. The request may be submitted at any time after charges have been preferred and must include the individual's admission of guilt. Although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate. b. Paragraph 3-7a provides that an honorable discharge is a separation with honor and entitles the recipient to benefits provided by law. The honorable characterization is appropriate when the quality of the member’s service generally has met the standards of acceptable conduct and performance of duty for Army personnel, or is otherwise so meritorious that any other characterization would be clearly inappropriate. c. Paragraph 3-7b provides that a general discharge is a separation from the Army under honorable conditions. When authorized, it is issued to a Soldier whose military record is satisfactory but not sufficiently meritorious to warrant an honorable discharge. DISCUSSION AND CONCLUSIONS: 1. The applicant's request that his discharge be upgraded so he can obtain benefits was carefully considered and it was determined that there is insufficient evidence to support this request. 2. The applicant's request for separation under the provisions of Army Regulation 635200, chapter 10, for the good of the service to avoid a trial by court-martial was voluntary, administratively correct, and in compliance with applicable regulations. 3. There is no evidence that shows the applicant was not properly and equitably discharged in accordance with the regulations in effect at the time and that all requirements of law and regulations were not met or that the rights of the applicant were not fully protected throughout the separation process. Based on the seriousness of his misconduct, the applicant is not entitled to either an honorable or a general discharge. 4. In view of the foregoing, there is no basis for granting the applicant's requested relief. 5. Additionally, the ABCMR does not upgrade discharges based solely on the passage of time nor does it correct records solely for the purpose of establishing eligibility for benefits from another agency. The granting of veteran's benefits is not within the purview of the ABCMR and any questions regarding eligibility for health care and other benefits should be addressed to the VA.
