THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "XXX-72-XXXX." 2. The applicant states he provided the wrong SSN in basic training. 3. The applicant provides his DD Form 214 in support of his application. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's record shows he enlisted in the Regular Army on 1 July 1964. The service number (SN) was the primary identification number used by the Army at the time of the applicant's enlistment. His DD Form 4 (Enlistment Contract – Armed Forces of the United States) does not list an SSN. The applicant's record contain a DD Form 398 (Statement of Personal History) prepared him during the enlistment process. This document lists his SSN as "XXX-72-XXXX" in item 13 (Employment). 3. His DA Form 20 (Enlisted Qualification Record) prepared on 5 August 1966 lists his SSN as "XXX-76-XXXX" in item 1 (Name and SN). 4. Documents in the applicant's Military Personnel Records Jacket (MPRJ) that list an SSN show both numbers "2" and "6" as the fifth digit of his SSN. The applicant's separation orders issued on 9 June 1968 which directed his release from active duty (REFRAD) on 9 June 1968 list his SSN as "XXX-72-XXXX" in the standard name line. 5. His DD Form 214 issued upon REFRAD on 9 June 1968 shows his SSN as "XXX-76-XXXX." DISCUSSION AND CONCLUSIONS: 1. The applicant's request to correct the SSN shown on his DD Form 214 has been carefully considered and is found to have merit. 2. The evidence of record confirms the applicant provided his correct SSN at the time of his enlistment. It further shows this SSN was erroneously entered in his record and on his DA Form 20 as "XXX-76-XXXX." The record further shows the REFRAD orders issued to the applicant during his separation processing on file in his MPRJ correctly list his SSN as "XXX-72-XXXX." Therefore, it would be appropriate to correct his DD Form 214 accordingly.
