Applicant Request: Upgrade Reason Change RE Code Change Issues: The applicant states, in effect, that his unit was heavily deployed to Iraq from Korea. When his unit returned things were disorganized. He had trouble returning to a normal life and felt he could not show weakness; consequently he began drinking heavily every night. When he asked for help he was told to stop being a [censored] and to drink more. After being accused of getting another Soldier high on marijuana he and three other Soldiers were told to take another UA and he failed for cocaine. He needed and asked for help only to be laughed at and ridiculed; it was then that he went AWOL. When he was apprehended and returned to military custody he was placed in Echo Troop, a troop for injured and troubled Soldiers. Everyone there was able to go in front of a board except him. He was never given an Article 15 or stripped of any rank like the other Soldiers in the troop, he was simply kicked out. Since his separation he has been diagnosed with severe PTSD and is currently receiving service connected disability of 80%. He has recently gotten married and went to truck driving school and he is now starting at [redacted] School. He feels he deserves a medical or honorable discharge instead of a general discharge. II. Facts and Circumstances: The evidence of record shows that on 13 June 2006, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 14, paragraph 14-12c, AR 635-200, by reason of misconduct, commission of a serious offense, for testing positive for cocaine (051116) and for being AWOL (060124 - 060323), with a general, under honorable conditions discharge. He was advised of his rights. On 28 June 2006, the applicant consulted with legal counsel, was advised of the impact of the discharge action, unconditionally waived his right to an administrative separation board (was not entitled), and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the Army and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed action and recommended approval of the separation with a general, under honorable conditions discharge. On 14 May 2006, the separation authority waived further rehabilitative efforts and directed the applicant’s discharge with a characterization of service of general, under honorable conditions. b. Legal Basis for Separation: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 14 of this regulation establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, and commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate; however, a general, under honorable conditions or an honorable discharge may be granted. c. Response to Issues, Recommendation and Rationale: After a careful review of all the applicant’s military records, the issue and documents he submitted, the analyst determined that the characterization of service is improper. The analyst noted that the government introduced into the discharge packet the results of a command directed competence for duty (i.e., fitness for duty) biochemical test. This is limited use information as defined in AR 600-85. Use of this information mandates award of a fully honorable characterization of service. Accordingly, the analyst recommends that the applicant’s characterization of service be upgraded to fully honorable. However, the analyst found that the reason for discharge was fully supported by the record and therefore, remains both proper and equitable. VII.
