THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show military education, all his awards and badges, and to show his deployment dates. 2. The applicant states his discharge proceedings were expedited and there was no time to correct his DD Form 214. 3. The applicant provides: * DD Form 214 * Enlisted Record Brief (ERB) * DA Form 1059 (Service School Academic Evaluation Report), dated 6 November 2008 * Warrior Leader Course Diploma for the period 122 October through 6 November 2008 * Permanent Orders Number 148-123, issued by Headquarters, Multi-National Division (Baghdad), Iraq, dated 28 May 2007 * Permanent Orders Number 100-3037, issued by Headquarters, U.S. Army Infantry Center, Fort Benning, GA, dated 9 April 2004 * Permanent Orders Number 191-01, issued by Headquarters, 2nd Battalion, 325th Airborne Infantry Regiment, Fort Bragg, NC (date not available) CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 21 August 2003 and upon completion of initial entry training he was awarded military occupational specialty (MOS) 31U (Signal Support Specialist). His MOS was later redesignated as 25U. He reenlisted on 22 December 2005 for a period of 5 years. 2. Permanent Orders Number 100-3037, dated 9 April 2004, awarded him the Parachutist Badge for successful completion of airborne training on 16 April 2004. 3. Permanent Orders Number 191-01 awarded him the Army Achievement Medal for meritorious achievement during the performance of his duties while assigned to his unit in Iraq during the period 12 to 29 April 2007. 4. Permanent Orders Number 148-123, dated 28 May 2007, awarded him the Combat Action Badge for actively engaging or being engaged by the enemy in Iraq on 1 May 2007. 5. A DA Form 1059, dated 6 November 2008, and accompanying diploma provided by the applicant shows he successfully completed the Warrior Leader Course during the period 22 October - 6 November 2008 (2 weeks). 6. Section VII (Awards and decorations) of his ERB shows the following: * Army Commendation Medal * Army Achievement Medal (2nd Award) * Army Good Conduct Medal * Global War on Terrorism Expeditionary Medal * Global War on Terrorism Service Medal * Combat Action Badge 7. On 26 February 2009, he was discharged from active duty. He completed 5 years, 6 months, and 6 days of creditable active service. The DD Form 214 he was issued at the time shows in: * Block 12f (Foreign Service) the entry "0000 00 00," indicating no foreign service * Block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) the: * National Defense Service Medal * Global War on Terrorism Service Medal * Army Service Ribbon * Block 14 (Military Education) no entry for completing the Warrior Leader Course * Block 18 (Remarks) no entry for any deployments 8. The Defense Finance and Accounting Service (DFAS) confirmed the applicant received hostile fire/imminent danger pay (HF/IDP) and combat zone tax exclusion (CZTE) for service in Kuwait/Iraq during the period: * 9 December 2004 - 26 March 2005 (3 months and 18 days) * 6 September 2005 - 28 December 2005 (3 months and 3 days) * 5 January 2007 to 16 March 2008 (1 year, 2 months, and 12 days). 9. Army Regulation 600-8-22 (Military Awards) provides Department of the Army policy, criteria, and administrative instructions concerning individual military decorations, Army Good Conduct Medal, service medals and ribbons, combat and special skill badges and tabs, unit decorations, and trophies, and similar devices awarded in recognition of accomplishments. It states: a. The Iraq Campaign Medal is awarded to members who have served in direct support of Operation Iraqi Freedom (OIF). The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 through 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign. During his service in Kuwait/Iraq he participated in the following campaigns: * Iraqi Governance (29 June 2004 - 15 December 2005) * National Resolution (16 December 2005 - 9 January 2007) * Iraqi Surge (10 January 2007 - 31 December 2008) b. The Noncommissioned Officer Professional Development Ribbon was established by the Secretary of the Army on 10 April 1981. It is awarded to Active Army, Army National Guard, and U.S. Army Reserve Soldiers for successful completion of designated noncommissioned officer professional development courses. It provides that completion of the Warrior Leader Course qualifies for award of the basic ribbon. c. The Overseas Service Ribbon is awarded for successful completion of overseas tours. Numerals are used to denote the second and subsequent awards of the Overseas Service Ribbon. According to the Awards Branch at U.S. Army Human Resources Command, Iraq and Afghanistan are considered isolated areas where tour lengths have not been established by the Department of Defense. Soldiers who serve 11 cumulative months in a 24-month period or 9 months continuous in Iraq or Afghanistan get credit for a completed short tour. 10. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It provides standardized policy for the preparation of the DD Form 214 and states for: a. block 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214; b. block 13, list awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22; c. in block 14, list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214, to include title, length in weeks, and year completed; this information is to assist the Soldier in job placement and counseling; and d. block 18, for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)." DISCUSSION AND CONCLUSIONS: 1. The applicant's ERB shows he was awarded the Army Commendation Medal, Army Achievement Medal (2nd Award), Army Good Conduct Medal, and the Global War on Terrorism Expeditionary Medal (for his first deployment to Kuwait/Iraq); however, these awards are not shown on his DD Form 214. Therefore, it would be appropriate to correct his DD Form 214 to show these awards. 2. Based on his last two deployments to Kuwait/Iraq, he is entitled to the Iraq Campaign Medal. Additionally, he participated in three campaigns during these two periods. Therefore, his DD Form 214 should be corrected to show the Iraq Campaign Medal with three bronze service stars. 3. Permanent orders awarded the applicant the Parachutist Badge and the Combat Action Badge. Therefore, his DD Form 214 should be corrected to show these badges. 4. Based on completion of the Warrior Leader Course, he is entitled to the basic Noncommissioned Officer Professional Development Ribbon. Therefore, his DD Form 214 should be corrected to show this award. 5. Based on his last tour in Iraq, he is entitled to award of the Overseas Service Ribbon. 6. DFAS confirmed the applicant received HFP/IDP and CZTE for service in Kuwait/Iraq during three periods totaling 1 year, 9 months, and 3 days of foreign service. Therefore, blocks 12f and 18 should be corrected accordingly. 7. Records show he completed the Airborne Training Course that led to his award of the Parachutist Badge. Therefore, his DD Form 214 should be corrected to show he completed the 3-week Airborne Training Course in 2004. 8. A DA Form 1059 and diploma confirms the applicant completed the 2-week Warrior Leader Course in 2008. Therefore, his DD Form 214 should be corrected to show this course.
